  • Am I justified in being none too happy with this ...

    Finally finished training for my new job. That's a story in itself, for another category, but here's my question: I was told when I was hired that my designation was such that I would get 0-16 hours per week (not seasonal, but not regular part-time either). I was okay with that. As a result of this designation (there are many new people with the same designation) we get no health benefits at all.

    Now I've been told by two people (although not confirmed by anybody in authority) that this maximum of 16 hours a week ONLY applies to weekDAYS. They can and will also give you shifts on weekENDS, that will take you over that 16-hour "maximum," but ... we are still not eligible for benefits (unlike the regular part-timers).

    So ... am I justified in feeling that this mega-corporation has found yet another way to screw its employees?

    This is one of multiple issues I have with this place, although give my difficulties in finding work over the past few years, I'm not going to quit over it -- at least, not until I've got something else lined up. Other issues will go in another post.

    First off, it is not a problem until it happens.

    If & when it does happen...
    The question becomes how regularly does it occur. They don't tend to grant benefits one week and pull then the next as your schedule fluctuates. To be eligible for the benefits, it has to be a "regular" occurrence. By your local laws, what defines "regular"?

    The next question is "Do you want the extra hours?" I am pretty sure that they can make sure you never work more then 16 hours. There are probably employees who appreciate the extra hours.

    So, did mega-corporation find a way to screw the employees or did it find a way to help the employees? That discussion goes to fratching.

      This sounds like bullshit to me and rings all of my ex-union-steward bells.

      Weekends are still part of the week. 16 hours per week are any hours that fall with in a 7 day period. If there is a minimum number of hours that you have to work to qualify for insurance, it usually means the cumulative hours for the whole year. And ALL hours that you work qualify toward that minimum. The weekend hours don't exist in a vacuum unconnected to the rest of the week. After all, they are still paying you for those hours, right?

      This sounds like they are trying to skirt the minimum-hours-for-insurance rule. Possibly this might vary by state so you might want to see what your state labor department has to say about hours counting toward insurance. But if they say you have to work, for example, 1000 hours per year to qualify for insurance, then ALL HOURS that you work MUST be counted toward that total.

        csquared: I had a LOT of additional shifts last week and this week, but we were told that, once the store was up and running (it's a brand-new site), things would calm down. So ... good point. Our official opening is October 18. I am loaded down with shifts that week as well. We'll see what happens after that. I agree that it's a matter of perspective; I personally don't WANT all these shifts but I'm sure somebody does. I know some people there for whom this is a second job.

        P.S. I am definitely NOT trying to start any fratching here. I just wasn't happy with the alleged splitting up of the week. If I continue to be loaded down with shifts, I will go into HR and ask what happened to the 16-hour-per-week maximum and see what they say.

        MoonCat: That was my thought: Saturdays and Sundays are STILL part of the week. However, before I go off the deep end on this I will wait until after our official Grand Opening and see what my hours look like then.

          I can see the "temporary bump" in hours as the store is setup. If it continues, then you should question it. Here in the States, Saturday & Sunday ARE part of the week. I would assume the same is true North of the Border.

          I find it hard to believe that Corp would try that kind of BS. Too big and wide spread to not be noticed, reported & investigated. I could see a scattering of stores. Personally, I would take what you heard with a grain of salt.

          Also, I was not implying that you were venturing into fratching. I wanted to prevent my comments from going there.

            Another vote for "it's all one week" here. Weekends can sometimes cause pay bumps of their own due to unsocial hours but that doesn't separate them from the working week.

              The work week has seven days. Saturday and Sunday are treated no differently unless it means getting MORE money/bennies for working those days, not less. If they don't count, don't have anyone working those days and just stay closed.

                MoonCat: My old company got out of paying overtime because apparently according to the union contract, Sunday did not count in an OT calculation as it was already time-and-a-half

                  I agree with the rest UNLESS they have a pay differencial or premium for working weekends. That would be on of the only ways they could not count weekends as normal hours as I assume this store operates 7 days a week.

                    I would opine that you shouldn't say anything to management, but instead keep an eye on it. If it turns out you qualified for health care under the law, then you're effectively covered, even if you have to go up before the labor board or file a lawsuit to get reimbursed.
