  • He threatened to sue me!

    I had a good one about 20 minutes into my shift the other day:

    Some older guy (I'd guess his 60's) has a computer in his cart and strolls up to my line. I zap it with my little hand scanner (I love that thing), scan the serial number, and then ask him if he would like the 2-year service plan. The plan automatically prompts on the register for computer or large TV purchases.

    He gets all huffy and says "I ain't buying no goddamn ripoff plan. If it craps out in 2 years I'll bring it back!"

    A bit befuddled, I said "Sir, you DO realize that Wal-Mart's return policy on computers is only 15 days?"

    SC: "You're shittin' me! It takes longer than that to ship it from China!"

    Me: "Be that as it may, if you don't buy that 2-year plan, you'll only have 15 days from today to return it if something goes wrong."

    SC: "If it stops working I'll stop payment on my credit card and bring it back! And if the store doesn't take it back, I'll sue (points to me) YOU for selling it to me!"

    Me: "You do that."

    Good luck with that, buddy. Let me know how that works out for you.

    America, the only place where you can sue somebody for the most insipid things and win a million bucks too. Why are people so stupid anyway?

        And wal-mart's general return policy is 90 days. What the heck was he thinking? He's probably just some old goat,(my apologies to any goats ) who thinks that the word "sue" can make people bow to his will. Jerk.

          I love it when people can't put two and two together and instead use the word "sue" to remedy the situation. Like you're going to be served papers because you told him about the return policy and he didn't like it . I wouldn't be suprised if he brought the tower in with an axe in it and tried to take legal action.

              This didn't happen to me, but it did happen to a co worker.

              Some idiot law student from across the street (I realize that was redundant) threatened to sue a girl I worked with for assault.

              The reason? My co worker touched a notebook in a stack the SC was holding and said "Do you mean THIS notebook?" They were discussing something like the size of a notebook the SC was looking for or wanted copied or some such thing.

              Yes. She touched. With her finger. A notebook. The SC was holding.

              These law students think they are freaking geniuses, but I swear I don't think I've ever dealt with a stupider, more entitled, superiority-complex ridden group of people in my life. And considering I waited tables in the trashy side of town, that's saying something.

              We were like, okay, let's save the security tape. Whatever.

                Depending on the bank you are with, you only have a certain amount of time to dispute a charge. I know with my bank its 90 days. Then no chargebacks are allowed.

                So basically, if you call to reverse a charge after two years, I wouldn't be suprised to hear that he threatened to sue the bank when they laugh at him.

                  Well, Social Security money isn't going to be around much longer (especially when I get to be the old goat age, heaven forbid I make it that long). How else are these dumb old goats going to get money other than to try and sue people?

                  As for the rest........it looks like most people just think that threatening to sue is going to scare someone into giving in to them. There are lots of stupid lawsuits out there, but unfortunately, the stupid party usually DOES win and get compensated, which is what makes the threat of being sued actually kind of scary at times.

                    The old adage, "A Little Knowledge can be a Dangerous Thing" proves itself to be true far too often. Grad students are the worst when it comes to this. I saw it first hand.

                    I can tell you the best retort to such an ignorant misstatement and inane attempt at intimidation is to immediately change your attitude from pleasant to business brusque and say, "I'm sorry, but as you now have threatened legal action against this store, company policy forbids me from completing your transaction or having any further conversation with you. All future communication must be through our corporate attorney. Now, would you please put down your items and leave the store? I need to go and make a report of what just happened." You can enjoy watching the student’s jaw will hit the floor and seeing the student start sputtering. The student will realize how STUPID he/she acted in trying to show off - and will see how the term “lawyer” or “law student” does not impress and scare people like he/she hopes.

                      the law student thing was paticularly dumb as anyone with even a basic understanding of the law would know it wasn't assault.

                      basic definitions

                      Assault: words or actions causing the victim to feel threatened

                      Battery: unwanted touching of the victim, the most extreme case i can think of was were a man was found guilty of battery for rubbing the skirt of a woman

                      the law student was either very stupid or trying to scare the employee to get freebies.

                        When I hear of law students I'm reminded of talkradio hours where the host asks listeners what they THINK the law or punishment should be for something like a charge or event recently reported in the news. Invariably during the second quarter a caller will identify himself as a law student and state the law as was stated at the beginning of the hour or was otherwise commonly known.

                        I guess for some, the education eliminates the distinction that one can have personal opinions about the law.
                        I second that Frederick Douglass quote--unfortunately, so do a lot of SCs.
