    With the problems in my employment (including losing the job), my wife and I got really late on our rent. Last Friday, I received a summons. My landlord is petitioning for eviction.

    I called the lawyer but he said there isn't anything he could do to stop it without the office telling him otherwise. Management says they can't stop it unless we brought fully current: last month's and this month's rent. Ever rent assistance program is out of funds until September 1st. I can get the money for one month's rent as my wife is paid on Friday.

    The timing really stinks on this, too. The court date is September 2nd at 8:30 in the morning. The office doesn't open until 9AM so if I pay with my wife's check, I still have to go to court. Rent assistance said to call them on September 1st but I have no idea when the money would be dispersed. I don't even know if I even qualify.

    I'm literally at the point of desperation. I was looking at Creditloan.com, seeing about their Bad Credit Loans, looking at how much my vehicle is worth for a title loan, something, ANYTHING!

    (Also, when you're in court, it'll probably be a 'has it been paid yet? yes? ... come back later.' thing. BUT IANAL! I can tell you, however, court looks scarier than it actually is. The actual scary comes from why you're there, and what can happen. The judge only bites when he's allowed to. )
    EDIT: there's also a thing called decision fatigue. In other words, earlier the better for best results! Read the article anyway, it's cool. SFW, NY times.

      Pay the last month's rent Friday when your wife gets paid. You'll owe it no matter what else happens.

      Call Rent Assistance on Sept 1st, and do what ever you have to do and get it done that day. Get documentation if possible, even if you can just get something faxed.

      Then go to court on Sept 2nd and tell the judge you have paid the rent that was behind, and are trying to get assistance for the current month. Show him the documentation if you are able to get it. Give him the name and time of the person you talked to if not (he may not want to hear what the person actually said if you have no documentation as that is hearsay). Give him a reasonable time frame in which you think you can get current.

      Odds are the judge will give you time to get your ducks in order before issuing an eviction order. Sending a summons over 1 months rent is rather premature.

      If he gives you time to get it together, do what ever you must to get the money together! If you have to go back to court, the judge will likely not be sympathetic.

        All my work came to nothing. I could get neither rent assistance nor could I get the loan in the amount I'm needing. Basically, I have to go to court tomorrow and say, I couldn't pay the back rent because I couldn't get help but I have the money order with me. Somehow I don't think it'll be enough.

          Oh no, I wish there was some tangible way I could help...the only thing I can do is wish you luck.

          Our situation wasn't as dire, but the management agency called off the wild lemurs when our town's housing program told them they were working with us--they didn't/couldn't divulge whether we had been accepted, only that we had an open file.

            It's odd. When I realized I had nothing left, I was upset. But now, I don't feel anything really. We've wanted out of this place for some time. This park has gotten worse and the management never follows through on anything.....well, except evicting us, of course.

            We're looking at other places, some smaller than what we have now but nicer, too. The managers I talked to all stated two cats are just fine (I'll take that with a grain of salt) and would be willing to work out the details of bad credit. One said, "In my experience the only person we didn't rent to was someone with a bad criminal background." I replied, "Well, I should be okay. That nuclear armament smuggling thing should have fallen off by now." She laughed.

            I hated the idea of losing this place but I think I was more scared of losing. I'll still try to work out something tomorrow. Whatever happens, my wife and I are declaring bankruptcy after this. It's time for a fresh start.

              Times like that are rough and never easy.

              If you are in the USA you may want to take a good look at your debt (unsecured loans, etc.) and consider bankruptcy if a good % of your money is going towards them.

              Food stamps, and other assisstance programs.

              Might I also plug the Angel Food Ministries? They've been a HUGE help to us and our budget.

                    just a warning, it will cost around $2000, plus the cost of the mandatory credit counseling classes-and usually you have to have the money up front-bankruptcy lawyers know you're a credit risk.....

                        Chapter 7 bankruptcy is easy enough to file yourself without an Attorney. Just be sure that you understand what you will be giving up, what you will be keeping, what debt you will still owe, and what the ramifications are for your credit and future needs.

                        For that, you may need a bankruptcy attorney or credit councilor. I've never seen someone be able to navigate a Chapter 11 or 13 bankruptcy without an attorney.

                          It's over. It was a limited answer hearing. I stopped trying to decide on saying I admit the charges and leaving or fighting. I looked it over and I asked my wife, "Is this place really worth fighting for?"

                          This place went down hill in 3 years. Stuff was stolen, they never fixed our door, they never gave us the shed we needed. They never followed through with anything they said they'd do. Just evicting us. We've had 4 managers in this year alone. Our neighbors are transient at the best of times, scary at the worst.

                          "No," she said. "It really isn't. That place is crap and we both know it." With that in mind, I signed "Admit" and walked out.
                          The lawyer is supposed to call me sometime to today to make the arrangements. The way things are going right now, it looks like we're moving to Springfield, MO again. A true, fresh change.

                          My wife will stay here and stay with friends. We're going down tomorrow to look for a home or an apartment. It's cheap there and my friends that live in the area have worse credit than we do and they got a 2 bedroom, 1 bath home for $450/month. The same would go for $800 here. We just have to make sure where ever we go, they accept cats. We're not giving up our fuzzballs.

                              What happened this weekend...I can't accurately described. My wife and I went to Springfield, MO to get out of town, get away for awhile and look to see if we might be able to find a place. The first place we called, he wanted to show it to us that day. We went...and it was GORGEOUS. Much larger than our current home, two car garage, cheaper than the trailer, and a far, FAR nicer neighborhood. But I didn't get my hopes up.

                              He talked to us and asked about the application. He asked, "If I call your current landlord, what would they tell me?" So, I was upfront with him. I told him about the eviction, that we needed somewhere to go, and our plans. He shrugged and asked about the deposit. We outlined our offer. He said "Okay. Here's the lease."

                              Flabber-freakin-gasted! I went from looking at my family being potentially homeless to FREAKING UPGRADING! We can keep our cats, decorate as we want. It's a duplex but who cares??

                              We officially move in two weeks. My wife will have to stay here until she gets a job and I'm looking for one now, too. But once she does....we'll be there.

                              A fresh start.
