    BG/I lived in this same house since I was born. /BG

    I live on a property that is 1.75 acres. It's rather long. Our house is closer to the left (4 feet from the border). Back in the early 80's, someone bought the property to our left. They built a building, as long as our house, flush to our house-really 8 feet from our house to their building. So that side of the house is 95% in the shade. My mom wanted my dad to talk to the neighbor when they started to stake where they were going to put the building, but either my dad didn't talk to the new neighbor or the neighbor didn't give a shit. To be honest, the neighbor has been nice to us. But there was no reason that the building had to be built in that space. There is plenty of space in the back or more to the neighbor's left, since no one lives to his left. The neighbor doesn't live anywhere near us, though.

    In general, the neighbor is ok. Though around the late 90's neighbor's kid started living in that building. The kid is in his 30's or 40's and needs to take his meds, but don't. One time he stole our dog and had the dog tied up on the property, but we could only hear our dog, not see it. WE called the neighbor (not the kid) and we got our dog back.

    Latter, neighbor rents his building to businesses. One business was a lawn-care business. NO problems with them.

    Around 1997 some people (let's call them "Shitty neighbors, sn") buy the property to the left of our neighbor. Mom made friends with them. They own a business that involves trucks leaving their property at 4-5am, and the trucks are loud. One time the cops came to our house asking about sn; seems they are dealing drugs. I don't know what my mom told the cops/investigators, but sn stop talking to my mom. Mom believes that sn dealed drugs. Around this time a friend of my mom decides to get married and wants the reception in our yard. Mom goes to all the neighbors to tell them about the party (months in advance), that it will be loud that night, since there is a dj. NO one objects. Of course, night of the reception, someone calls the cops for us being loud. Mom believes it was sn. Of course, sn has no problem that her kids come to our house to sell stuff for school fund-raisers.

    About 2004, neighbor rents his building to a car storage and wreaker business. Assholes own dogs. The dogs get in our yard, kill animals that are in our yard, and of course the losers blame us for having the food for the animals out. Another time one of their dogs got in our yard when my mom was alone and it threatened my mom. Luckily the owner came up and restrained it quickly, but neighbors are never apologetic.

    These wreakers leave but because the neighbor sold his property to sn, I think it was Summer of 2011. By this time my mom is really ill. They sn decide to operate the building as a party hall. It's not insulated for noise, and the parties are fucking loud. First time there was a party I called the cops around 1am to complain. Sn show up the next day, acting passive-aggressive about. I explain my mom is really sick. She seemed sympathetic. Not long after mom gets worse and spend the last 3 months of her life in a hospital.

    NOw maybe 1 or 2x a month there are parties in this building since before my mom died. It's fucking loud. I live in an unincorporated area, and there are no deed restricitions. I'm annoyed. People suggest I just go over and join the party.

    Also, sn wants to buy my property, since she wants to raise horses. My family and friends tell me to watch out for her, she might try to steal my land from me. For ex., she wanted to rent my back property. A family member tells me that if she rents and improves it a lot, latter on she can claim the property since she improved it.

    Right now she has a party going on. I didn't sleep much fri. morning since I went with a friend to a Magic game, and Sat. morning I woke up early to set up a garage sale. I really am tired, but I can't sleep. And sometimes my house shakes.

    I suggest you talk to a lawyer.
    Customers should always be served . . . to the nearest great white.

      I have to second what Kristev said... most first consultations are free, and you can get an idea of your rights/options/whatever

        Yes, good idea. The lawyer can let you know what the nuisance laws are in your area. Your neighbors could be breaking the noise ordinance, if there is one. Also it's possible they don't even have a business permit for that party hall (not sure how or if you could find this out, though). Good luck. I HATE having neighbors. I'd be happier living next door to a cemetery (at least they're quiet!)

          If it's unincorporated, then talk to the county authorities. They would be in charge of what uses land can be put to, since there is no town or city exercising jurisdiction in your case.

                And this, dear friends, is why I like where I'm living right now. My parents own three lots including the one the house is on. We're on the edge of town. Our only neighbors are waaaaaaaaaaaaaaaaay the fuck at the other end of the road. One of them owns the property just north of us and the property across the road, but he's usually not a bother. People want me to move to <town I work in> and have neighbors all up in my business? Fuck that! That said, I do agree with everyone else in that a lawyer would be a good thing to get lined up. quickly!

                  A renter can't put a claim on property simply because they improve it.

                  First of all, they can't make ANY improvements without the owners permission. I rented the same house for six years. I had to get permission for one of my roommates to repaint his bedroom, and even then only on the understanding that he'd repaint it when he moved out or I'd lose my security deposit. I never repainted anything else because my landlord (who was actually a nice guy overall and good about fixing problems quickly) didn't want to give me a break on rent to repaint.

                  Secondly, any money they put in, they lose. For good. They can't even claim a discount on rent for it unless the landlord agrees. This is why most renters don't do much to keep up rented property. Why should they? They get nothing for the investment. This is why renting is a big rathole for your money. No matter how long you live there, or what improvements you make, you get not one centavo in return.

                  Now I bought appliances for places I rented . . . those I could take with me when I moved out (and did). I even sold a dishwasher (the kind that rolls and hooks up to your sink) at a loss to avoid giving it to my land lord (that was a different from from the one above, and who was a real jerk).

                  What you may be screwed on is the neighbor's building. It's probably not set back enough from the property line. And your house may not be either. It depends on your local code regulations. If you let your neighbor use your property and don't charge rent or do anything to force him to stop, then you grant an "easement" which gives not only neighbor, but anyone else the right to use the right of way on that land.

                    I third, fourth or whatever it is up to - get a lawyer. They'll know local laws & ordinances, obscure things that might work to your advantage, things to warn you not to do in case it sets some sort of precedence, etc. Actually, you might even want to look for a lawyer who specializes in real estate law.
