Some states require all parties know, some require 1 party know about recording. simple solution. When they start in on you, you state 'I just want to let you know I am recording this conversation for legal purposes.'
Thus everyone knows (and you want that because if 1 party is in a 'everyone must know' state, you can get in trouble for not saying it) and he doesn't have the fun of being abusive, cause he'd be worried it would be played in court.
