    It's the internet silly! It automatically makes it impossible for what you post publicly to be seen by anyone you DON'T want to see it! Unless you get "hacked".

        Really? You want me to believe that the guy who did not work there (but was still sitting at a desk and taking calls) took the security video, copied it, and uploaded it to YouTube?

        Sad thing is, I do believe that your Management is that incompetent.

        I am almost a little worried if this is a violation of that states wiretapping laws now. I did not think of it till the article mentioned it but....

        In some states, only one person needs to have consent to be video or audio recorded. In others states, they require BOTH parties to give consent. BUT, the main problem is, I do not know of any state where you can take the video off of a computer system, that you do not legally own, to post in any form. And if they are in a state that requires "all-party" consent, we are talking major fines for a first time offense, even Jail if it is a second offense. At the very least a Civil case could be brought against the up-loader and maybe even the dealership (in theory, I am not well versed in the law).

          None of us are lawyers, so I can only speculate:

          - The video was from security cameras, which were put there by the dealership -- so, the owners of the property allowed the recording to take place; anyone else who comes in, by definition, is implying their consent to be recorded, and they can just avoid the place if they don't want to be on tape

          - The issue may be with the legality of *uploading* the video; perhaps a copyright or ownership issue? We'll just have to stay tuned to the articles to see what happens in lawyer-land

            So we pretty much have two theories here:

            1) Management or an employee uploaded it
            2) The NON-employee who is sitting at a desk using their phones somehow managed to get the footage and upload it

            If #1 then management is lying through its teeth. If #2 then there are some _serious_ security problems here.

            Neither of these scenarios make this dealership look good...

              Usually in those cases (IANAL, of course) I think they also have a sign by the entrance advising prospective customers of that fact as well, which I would presume counts toward "informed consent."

                This depends a lot on local laws; here in Texas, for instance, you can't record audio for a conversation without the consent of both parties. (This is often flouted but it's possible to get dinged for it.)

                    That's what I'm saying, yes. IANAL, as I said. And of course the Sucktomers would argue that they "never saw/read the signs" and "never gave their permission to be recorded," but I think most shops' lawyers would argue that posting the sign in a visible place at the door is sufficient notice.

                      I believe a well know legal principle is that although you do not read the fine print, it still applies to you. That also goes for posted signs. If you don't believe that, try telling the speed cop you didn't see or read the speed limit sign.

                          That's really nice!

                          Of course, did the original dealership ever come up with their promised tip to Jared? I'm willing to bet they didn't and are hoping the offer will get forgotten.

                          I understand their Yelp reviews were bad before and are completely in the crapper now. I'm waiting to hear they've closed the place and the word for when they reopen somewhere else under another name, which I'm sure they've done before. I don't see that working this time around, this video has gone too viral and no one's going to be fooled by the new name this time!
