Guest: Dave, you have one pissed off customer right now....I got a coupon for a $5 come to the beach rebate and I have been calling for over a month now and still havent gotten my $5. This is my last GD phone call before I get my lawyer involved.

So accounting tells me to tell the man we will cut him a check for $5 and I tell him that.

Guest: well thats all well and good but what about the fact that I had to wait so long for it, isnt that being taken into consideration?

Me: well I do apologize for that

Guest: thats not sufficent, I expect some compensation for that in addition to the $5

    Me: we cant do that

Guest: like I said, I have a lawyer I will be calling and I will sue and probably get punitive damages for thousands of dollars, is that worth it for $5

Me: ok well we arent paying you anything more than the $5 you say we owe you

Guest: young man, I dont like your attitude

    Me: I am sorry, sir

Guest: no you're not but you will be

I'm sorry that such an asshat like this person gets this worked up over $5! To involve lawyers - I don't think the $5 will cover the lawyer fees.

I wonder if, somewhere, some asshat has a lawyer on retainer for stupid stuff like this. Hell, I'm sure there are asshats everywhere that bug lawyers daily with assinine complaints like this all the time.

The shame is in the lawyer who takes the case....

i'm betting he doesn't call the lawyer, or that he does and the lawyer dies laughing.

no self-respecting lawyer would handle a case that pathetic.

This is the point where I will call their bluff and tell them, "I'm sorry, sir, but since you've disclosed that you're commencing legal proceedings, I can no longer communicate with you on this matter. Your attorney will need to contact our attorney/legal department to handle any further details, and I will make note of the day and time of this call and its content. Have a nice day." <click>

I really doubt he's going to get a laywer in on this. Even if he does waste his time and money on a consultation the lawyer is probably going to laugh his ass off. Unless it's that guy from Beavis and Butthead.

Ok, so it was a $5 rebate, and he's complaining it's been a month. I seen rebates take 10 weeks to be sent to me, and I have a rebate I sent to Walgreens back in April and I still havn't gotten it. I'm not expecting compensation, but I'm not planning to get anything anymore from Walgreens that needs a rebate.

Next time Buttplug calls about his rebate tell him to save the trouble paying a lawyer because there are no laws that require businesses to honor rebates. Be sure to tell the judge THAT if that brownstain makes good on his threat to sue.

You've stated how expensive these rentals are in other posts. Why would a $5 rebate even be offered for something that costs over $1000?

Actually in the rare cases of that happening at my hotel, we tell the guest pretty much the same thing. Once the mention of a lawyer is brought up, we stop the conversation and tell them to have their lawyer contact us.

As far as I know, the only way he could ever get punitive damages for waiting "too long" to get his rebate is if the rebate documentation had something in it specifying exactly when the rebate will be sent to him. No specified deadline, no punitive damages.
