Because most law enforcement agencies, television notwithstanding, really do not understand the first friggin' thing about how computers or the Internet actually work.
Absolutely - my local constabulary require referrals to the 'High Tech Crime Unit' to be made by FAX! I don't really need to say any more than that.
A PSA, if I may, as well as another.

        LilFilly,

If it does come to finding the timestamp on the files and proving that you/the others were elsewhere when the files were downloaded, please, please remember that it's possible to determine when the download was started even if the local information (ie, a**wipe's HD) is trashed.

If you or your lawyer need advice on how to get that evidence, ask us: though I can tell you the most basic part now: get a warrant, or .. hm. Maybe just the permission of the owner of the connection (ie, whoever's name is on your 'net bill).

Make a request to the system administrators of the cable company, providing as much information as you can. If you can get to the sysadmins and bypass the call centre, you're likely to get enthusiastic assistance. No offence to the call centre people - part of their job is to filter 'nuisance' requests away from the sysadmins!
But helping to locate child pornographers; and helping to clear innocent people; is not a nuisance request.

The information that will be helpful: file names if possible. File date/timestamp, as closely as possible. Source information if you can get it (IE: where it was downloaded from). Destination (where it was downloaded to), though they can pick that up from checking your assigned address on the day.

If you know any local geeks, particularly ones who are themselves sysadmins anywhere in the local area, ask them if they'd mind talking to other geeks until they find out who's running the local (internet company) servers. That's probably your quickest way to get to them.
        Seshat's self-help guide:
        1. Would you rather be right, or get the result you want?
        2. If you're consistently getting results you don't want, change what you do.
        3. Deal with the situation you have now, however it occurred.
        4. Accept the consequences of your decisions.
