Maybe Im just on the war path after how I was treated at my last job and have a real "no more mr nice kiwi" attitude right now but we have finally purchased a house and can leave our crummy apartment

-the one where we had no power or hot water for SIX days in the middle of a canadian winter, our hot water has broken down 4 times in 6 months (each time it took almost a week to have it repaired)
-the one where out electrical was so bad and dangerous plugs would litearlly FALL OUT OF THE WALL!!!
- the landlord would not replace or repair our sink until it started soaking the carpet and we were emptying a bucket of water placed under the leak a couple of times a day (and I threatened to stop emptying the bucket)
- the apartment that was DISGUSTINGLY filthy when we moved in, there were actually poo smears on the toilet seat! we spent 2 hours cleaning out furniture and junk from the previous tenants not to mention hours and hours of cleaning. When we told them about it he said "for $600 a month what do you expect"
-the landlord who took 5 weeks to get our mailbox key so that we had late charges on every single utility (hours on the phone explaining that) despite us calling him twice a week until we got it.

Anyway (breath kiwi breath)

We gave notice and today he thumps on the door and I open it and say hello, he says nothing just shoves some papers in my hand, then walks off ... have a nice day asshole! I start to read them, it is a THREE PAGE list of everything I have to clean if I expect to get my full deposit back....

once again.. there were poo smears on the toilet when we moved in!

The apartment is sparkling clean (im a germaphobe), its in much better shape than when we moved in, I have put so much time and energy into making this place as nice as possible so we can live in a decent dwelling. So im not worried about the deposit being taken away from that... what gets to me is

according to the BC tenancy legislation we have until 1pm, if they want tenants out earlier they have to negotiate.... on the letter it states that we "MUST VACATE" before twelve noon! or we will be charged...oh no no no, dont take that approach with me! I know my rights buddy, you want me to be out an hour early, you ASK me, you do not strong arm me into it with vague threats!:censored:

also, our carpets are so clean you could eat off them, as I said Im a germaphobe... they are vacumned every single damn day, no food is allowed on carpeted areas (we eat in the dining room) not even popcorn! In this information he has informed us we will be charged for steam cleaning by a company of their choice!!!!

OH NO YOU DONT:pissed:

Again according to the legislation, we arnt required to until we have been renting the property for longer than a year (we have been here 7 months) and again, if he has ASKED me, I would have done them myself. I will not be TOLD who im going to use or that I MUST do it.

Kiwi very VERY mad!!!!!

I have drafted a letter (Im going to wait and re-write it after im not so angry) containing the legistlation (copy and pasted from the government tenancy website) that states what he has asked for is not going to happen and that the legislation backs me up. I dont care if that makes me a sucky customer/renter. Im sick of people thinking they can demand whatever and not have to abide by the law.

That doesn't make you a sucky tenant at all! I'm going through a similar time getting my front door jamb and door knob repaired. They want a police report, but the police wouldn't file one since the damage happened when I was out of town for two weeks in Cambodia!

Anyway, I think rewriting the letter when you're a little less upset is a wise decision. And next time, take date stamped pictures when you move in and attatch copies of them to the Apartment State sheet that is usually filled out when you first move in. It's what I had to do.

I was working when we moved in and the boyfriend signed the damn sheet to sign off the apartment was in good condition (yes I wanted to strangle him) but within 24 hours I had called him and expressed my concerns.

Its not that I dont want to steam clean the damn carpet, its the attitude of the 3 page letter telling me how to clean my own apartment (down to the brands of cleaner) and that we MUST use the company they have on contract... no mention of this when we moved in.

I hate to say its the principal rather than the money, but it damn well is! This guy has been rude and has not done his job from the get go. We only picked this apartment block because it was close to my job. I will be forwarding all of this to his boss as well (all of our maintanence sheets for each time our tank blew) and the documentation of everytime he was rude or offensive.

You should go over the contract you signed when you moved in.... the landlord can't impose anything else on you!

This is a good idea. Don't just use the law to your advantage, but also things said and not said in the original lease/rental agreement. For instance, if the original lease/rental agreement did not specify that you had to use certain brands of cleaners or a certain steam clean company, then he has no basis to make such a demand.

Also, having a mom who was a secretary for forever is a helpful thing, and I can write devastatingly firm and to the point (and diplomatic) businessese letters.....if you want someone to look at your letter, or write a draft of it for you, just PM me. Always willing to help, especially if it means a dickwad like this will get his.

He CAN'T...but he will TRY. He sounds like classic grade A asshole, and trust me, he will try to get away with everything he can. This is why the best defense is a strong offense.

so the next three days are going to be really uncomfortable

I had a full blown panic attack this morning because possible renters are due to come take a look at the place "between 11am and 7pm" so im going to be on tender hooks all day... I have a REAL problem with people being in my space and possibly touching my stuff!

Im going out for afternoon tea with some friends and then to the gym... but at the same time I want to be here to make sure they dont touch my stuff or steal something.... ugh I can not WAIT until Im in my own apartment that I own!

My roomate and I are going through the same thing. No threats or anything, but we KNOW we are not getting any of the security deposit back.

He and I both are moving out June 1.

We are going to make this place sparkle. He did have a nice, tender hearted moment, and promised me that we will make it through this, and that if the landlords try to charge us for things that are basic wear and tear, we will both fight it until the end.

We know what's coming. With so many people in this building without money, they can destroy their apartment to kingdom come (like my neighbors for example) and the landlords know they won't be compensated, so they don't bother. They see people who work for a living, like my roomate and myself, and think, "Hey, we can nickel and dime these two to death because they DO have money!"

We aren't going to take it. Bring it on, Skid Row landlords, bring it!

Oh, Kiwi...

Can you have BF stay at apt while the "other tenants" are coming by? That way you don't deal with them?

And make sure you get a walk thru on day of leaving apt. My old landlords said oh no, you just turn in keys we do a walk thru.

I said nope...we do this together, and make notes.

Noticing how much of a turd this guy is, I'd take EXIT pictures. This way if he tries to stiff you, you can fight it.

And girl, kick his ass. Seriously. With your old boss-hag woman and this turd, you really have a dose of CRAP atm.

Hugs.

This just gets worse and freaking worse, he brought a group around to see (two couples and a single female) and says right in front of them...

"your phones been disconnected hasnt it?" ... NO IT HASNT YOU ASS, I said no and verified the numbers with him and he said "I rang those and they say disconnected" so I pick up the phone and theres a dial tone... so I suggested that maybe he dialed the wrong number... but apprently he doesnt make mistakes....:banghead:

But everyone was just staring at me!!! I was SO ANGRY, how embarressing to have that said in front of everyone. He tutted me for gods sake..I had steam coming out of my ears....

So I told him infront of everyone that the hot water tank is broken AGAIN and pulled open the cupboard so he could check it and asked him if he brought anymore fuses for it. He said he would come back later and deal with it (we called him yesterday about it and he said he would be around this morning) its now 4:30pm and he hasnt been back... yay no hot water for tonight again!

It was such a horrible scene, when he left I phoned kyle (whos at work and cant be home today but can over the weekend) who then phoned him and then he phoned me and apologuised. I just want to leave this place!

I wish someone would just :chipper:

Kiwi, my friend, I think you have just found your revenge on this asshat.

In addition to preparing the aforementioned documents to fight him from trying to rip you off of your deposit, etc., you should also feel free to be VERY social with any of the people that come to look at the place. I mean, what is your home will soon potentially be your home, so they are kind of like family, right? So welcome them in, and let them know all about the place. All the things you like about it. And of course all the things that may not be so great about it, too. I am sure when they have input from the soon-to-be-former tenant, they will make a wise and balanced decision about where they do or do not want to live.
