My husband works for Trane (where they make air conditioner) and was doing pretty good. He bidded for a job as welder. He was told that the company would send him to training for a week if he got the job, as he has no experience with welding.

He got the job and a raise from $12.25 to $16.50. He was happy. He has been training for the past two weeks, one week in class and one on the job.

Now senority has its privelages, especially on first shift, which you have to have like 15 years before you can get there, hubby has barely 2.

He found out that a welder on second shift that has more senority than him is going to bump him out of first shift. First shift doesn't want him, he is a troublemaker. My husband wasn't happy but accepted it, he worked second and third shifts before and was used to it.

NOW, the company is saying that they need someone with experience as welder. The job posting said no experience necessary and the union guy that John spoke to said not to worry that the company will send him to training. Now he is going to get bumped back to second shift and lose the welder position and the raise that he got.

John is very unhappy now. The company said not to let this be a setback and to bid on the next welding job that is posted. He was bringing in close to $1000.00 a week and now he will be bringing in around $500.00 and they don't want him to be unhappy http://img84.echo.cx/img84/2518/hissyfit8wr.gif .

I am also unhappy, too. The kids have clothes and they were even getting an allowance. I actually had visions of a great Christmas this year. Bills were getting paid, the kitchen was stocked and he was home in the evenings for dinner. We felt like a family. Although John can be a asshole at time, he is really a great man and father. We finally have insurance on the vehicles and money left over every week.

I know that we will manage, we have managed before with less. Although I am unhappy about this, I am still lucky that I can stay home with the kids while he works. Not many families can do that. I'm not sure what can be done, John has already talked to his union rep. He says that it is racial discrimination, he is the only black person that is in the position of welder, the guy that is trying to bump him is white. I don't know what to say about this since I am not there with him.

I'm not terribly surprised and don't think a racism claim will cut it. As you said, seniority counts for shifts, and John hasn't got it. The first shift job belongs to the other guy.

However, there is definitely a case then that John was given misleading information about job availability, led to believe that he would have first shift and then having it taken off him.

At least now he's got the training. Can he go somewhere else?

Seniority sucks..however, how can they give him a raise and then take it away? I don't see how this is legal. I would look into that.
