Well, it has been a challenge.

It finally got to the point where the carpets were going to be put in and the noise will not be heard anymore. I was excited that it was finally happening after a year of suffering.

The carpets were supposed to go in just before christmas. I called the strata council after to see why they hadn't been put in yet. I found out why I hadn't seen the guy from upstairs for about a month. It seems like he might be in jail and now has other people living upstairs in his place. The people up there from what I was told are not so good people. They won't let the strata in to install the carpets. Now something is fishy when someone doesn't want brand new carpets in their place. For some reason they won't let anyone in.

I have heard 3 fights already, and I can hear even more conversations then before because they are almost always in the bedroom. They walk like elephants so all I hear when they are home is worse thumping then before. It also sounds like they are moving furniture or something heavy almost every day, sometimes at 3am. I have been listening to the thumping and banging for at least an hour tonight.

The strata is going to try to get them evicted. I guess when you rent your place out you must fill in a form that gives the strata the renters name & contact information and guy upstairs didn't do that and they are not being cooperative. Also I gave the Strata manager my complaints about the fighting so he can use that as leverage. So the Strata meeting is on the 25th and I am going to try to go and see what happens. But the eviction process is probably going to up to 3 months. ARGGGGGG!

I am wondering if they are either dealing or making drugs or they have stolen goods in the apt. The living room looks completly empty through the sliding glass doors. A couple of cars have been stolen from the parking garage after they moved in as well, so i wonder.....

If the previous owner never filled out the sub-let paperwork, then they are living there illegally and the eviction should go much more quickly.

From past experience falure to allow the service people/Management people into the unit in a timely manner means one of the following.

Growing/manufacturing drugs: If they have setup one of the rooms or closets as a growroom its going to be hard to remove it quickly (unless they are smart), same with cooking up meth, although you would probably notice the smells from a meth lab.

Holding stolen property, its going to be very noticable if there are 14 dvd players still in boxes.

Having animals that they arent supposed to have, whether its like my old association was about no dogs, or something more exotic like a illegal feret or something.

excesive damage, its kinda hard to hide the 3 foot hole in the wall.

people living there not on the lease - bingo we know we have this as a winner.


Is this an apartment building (everyone rents from the same company/person)

or is it an HOA/COA (home owners/Condo owners association) if so request an executive session with the board of directors or a sit down meeting with the property manager.

In the US, california to be exact. We have a property management company (PM) which handles the day to day activities of the association and give guidance to the board of directors (BOD) both in legal in financial matters. The PM is well versed in the laws and can give you advice on what they would need from you to help them speed the eviction process along. Keep a written log, ours needed everything in writting. Remember if you are having such a problem with them, chances are the PM is as well. and they and the BOD would love any help you can give them.

Hopefully things and canada work somewhat the same as here.

Not sure where you live, but around here the tenents don't have to "let" the landlords in. The landlord has to give a day or two notice that they are going to enter the apartment to do work or something and then they're free to wander in and do whatever needs to be done. Whether or not the tenent wants them there, that's too bad most of the time, if there's some sort of conflict, an arragement can be made. But if it has become consistently a problem, the landlord has the right to give the notice and do what needs to be done.

Went to the Statra meeting last night and the eviction and court process has now been voted in favor.

He owes over 1,000 in maintence fees and fines so they are taking legal action against him for that and also they are going to evict them which gives the Strata their names at least.

What happened with the carpets is that the Strata had everything ready to go in, but he would say it wasnt a convient time, he wasnt home blah blah blah. then he dissapeared. Since he was going to have to pay the strata back on most of the carpet work I think he knew he was going to "dissapear" and decided not to get the carpets in.

Either way, I hope one or the other is successful. If the tenants get evicted, they will then enter the property and put in carpets, or if he has to sell they will do the same thing.

Oh yeah. It is an apartment building where people own but you can rent out your apartment. One of the Strata members last night is getting fustrated with all the renters in the buildings. We have a lot of not so good ones, messy, loud, the usual crap. But hopefully as the price of apt's go up it wont be financially benificial to rent your apt out and it will stop the renting.
