So, this happened to another driver last night...

  • So, this happened to another driver last night...

    Two drivers in this one: J & G. So, J originally takes the order to Mr Trailer Trash. The order is "wrong" and gets remade. G takes the corrected order. TT demands a discount. G states that he lacks authority to give discounts but he (TT) would be able to call the store and ask for one from the manager. TT calls G a "faggot" and starts dropping F-bombs left and right. TT's Skank states the the order is "still wrong" even though it matches what she ordered (this happens A LOT and is almost always cusDUMBer error). TT damands driver's "f-ing name." Driver states he will not give "f-ing name" and starts walking to his car. G gets into his car, sees TT running after him, so G hits the gas. TT dropkicks the taillight, leving a large hole.

    Sherriff gets called. G is informed that TT gets a LOT of complaints against him. G asks for options and recommendations. G decides he doesn't want to go to the trouble of sending to guy to jail for assault, but will take him to small claims.

    I'll keep you guys updated.

        That's what I said to the boss. She's unsure at the moment whether she will or not. In fact, she gave them a credit before she heard the whole story from G.

        (For the record, I work for this store as well, making PGG a co-worker of mine.)

        We're not part of a Big 3 chain, though we are part of a fairly sizeable local chain that's expanded to several other states in recent years. Still, to ban someone from ordering entirely is rare.

        Glad to know G is taking some action. I only got the basics from the boss because she didn't want to go into the whole story yet again. Now I know.

          G is obviously not thinking this through since small claims probably won't mean much to a TT like this. G seems a very passive person and I can tell he's gonna have a rough life living in the States.

            It doesn't seem like "TT" will probably even show up to court. He'll probably think the damage is too insignificant (errr, "stoopid").
            This area is left blank for a reason.

              Hmmm... I worked for a Corporate PJ and we banned people left right and center. I also worked for a LARGE franchise chain of PH (about 50 or so stores) and we banned people too.

                Ah Damn. Shoulda had TT arrested, I say. Does your drive have insurance? Shouldn't it be partly up to insurance to sue this guy? Of course, then the driver would have the deductable plus the insurance companies tend to frown on increased driving time, such as what a delivery driver has. Suck all around, I guess. I with you all luck getting payment from this lowlife.

                  Um, I'm not sure what exactly you mean by that, considering G was born and raised in Ohio, and isn't exactly a young kid...and as someone who knows G personally, I can tell you that "passive" isn't the first thing that comes to mind when I think of him.

                    I don't know of a blacklist for anything other than checks.

                      He only has liability because it is the standard pizza beater. He didn't want to arrest him because it would be too much trouble in his opinion.

                      There is a loophole in that. If a driver feels that their safety is threatened, we don't have to deliver it so long as there is a legitimate concern. This case gives legitimate concern, thus federal law states the driver can refuse to grant service as it would reasonable constitute a hostile work environment.

                        Problem delivery customers

                        When I worked at a pizza place, we used to keep a list of adresses that we did not deliver too. The list was posted on the wall in the phone area. It was not a long list, so it was easy for the person taking orders to remember.

                          When I worked for a franchise of .... a major national pizza chain, we did occasionally ban customers.
                          The list was short, so we never had trouble keeping track.

                          There was one lady who proved impossible to please, so we told her she was outside our area, and to call the other store.

                          For bad behavior (such as described in the original post), we banned the neighborhood.
                          "Oh, I'm sorry but we don't deliver to Clark Street anymore. Well, it seems that one of your neighbors attacked one of our drivers."
                          This was remarkably effective. We were the only place in town that delivered, and ....
                          No matter how thug you think you are, the knowledge that all of your equally thug neighbors will resent you making it impossible for them to order a pizza for six weeks means you keep your hands off the Pizza Guy.

                            Small claims court is a lot more trouble than an arrest. G will have to file the case and pay a filing fee, then serve TT (probably have to pay someone to do that), wait for a court date, appear, possibly appear more than once if TT gets the hearing date postponed, actually state his case before a judge, including preparing a clear statement of the loss, including pictures, and the budget to replace it, along with all fees incurred in the small claims process, then cross his fingers the judge agrees, and if G wins he than has to figure out how to collect his money from TT, as that is usually the responsibility of the winning party.

                            IMHO, IANAL, however, I have been through small claims as a plaintiff. It will take hours and hours of G's time and a chunk of money, probably much more than the taillight would cost to replace, to pursue TT.

                              IANAL either, but I do agree with wagegoth on the the fact that it will take G more time and money to pursue TT in small claims court. I sincerely hope that management would consider banning TT.
