      This is the sad part:

      The company is appealing the decision, saying is wasn't aware of the lawsuit until after the decision was handed down earlier this month.
      It's not the plaintiff's / complainant's fault that Pepsi didn't show up and now why are they being punished?

        Err, because a summary judgement against someone who didn't have the chance to respond isn't fair? Large company or not?

          When you are taken to court you are given plenty of notice about it and it is up to you to make any requests for changes etc..

          I am willing to bet that Pepsi DID know about it and ignored them - probably thinking it is an attempt to scam them. I'm sure they have a legal team and I am double sure it is not someone fresh out of law school.

            Actually, no. In some instances, you're not. There are cases where you're simply supposed to know you're being sued. In absentia, or some such. Don't ask me to pull the references, it was years ago, and they weren't on line. Basically, they get to say "hey, we made the notice available, it's not our fault you didn't look for it."

            What, you thought hitchhiker's guide just made that up?

              Laughs, "Yeah, some stuff it just requires public notice, such as forming a business out here, you have to post it to the public notices section of a paper. Thing is we have a lot of small papers out here of almost no circulation, so if you don't want it known, you just post it there. Plus this case does sound like a bit of a scam, are you telling me that bottled water didn't exist before Pepsi started bottling Aquafina (yes, i know the answer to that)?"
