  • My sister's divorce is finally in the works

    About a year after her husband threw her and their son out, and moved in the skank he'd been cheating on her with the two of them sat down and did a do your own divorce form online.
    He tried to argue her terms. She told him if he didn't agree she'd get a lawyer and go after him for back child support, then she did the calculations and it came up to over $5k. She told him she'd make sure the judge knew that as soon as he threw them out he canceled his son's insurance and it took her over a year to get him on Medicare because the state kept telling her he should be insured by his father.

    Basically she said "my way or I'll make you HURT!"
    So he agreed to her terms and they sent it in. Now she's waiting for it to be final and the nightmare to be over.

    It could have been even worse if they were in a fault state...could've dragged the little homewreckers, both of them, into court to talk about their affair for all the world to see...

      Like North Carolina, which still has an "alienation of affection" statute. The sister could have sued both the hubs and the skank.
      They say that God only gives us what we can handle. Apparently, God thinks I'm a bad ass.

        Which is fine... except there's huge damages awarded in those cases. One made the news last week, in which the person being sued wasn't provided notice, or her lawyer failed to make the appearance. In any case, the person wasn't present during the court case and was awarded an almost 10 million dollar settlement against her and her new love. And though neither party is ever really expected to exchange money, the loser will essentially have their credit and ability to ever pull themselves from financial hell nuked from orbit until the day they die. I dunno, I guess it seems a bit excessive, but it's the law of the land.

          Most states do....they aren't always taken seriously by judges. Nonetheless, I hope this goes well for her--promising start.

            The only real benefit I would think with the AoA is to get the girl in court to show everyone that the affair happened. This can ruin people's reputations...serves 'em right, too.

            But your sister probably didn't want to fight him over THAT too, as well as the other stuff.

              No, my sister wants it over with and a judge signing off on him having to pay child support.
              Bastard bought a new car instead of paying child support, and a new used car.

                I'm sure the judge would have just LOVED that.

                If he ever gives her trouble later, make sure she has the evidence about his cars. The judge will make prison for guys who hurt kids look like a walk in the park when he's through with him.

                  Oh yes. I wish I had the funds to provide her with an attorney for the divorce, but I don't and she only works part time and is living with our parents while she tries to go back to school and get a degree so she can make a better life for her and her son.
                  She has some health issues too and the issues can technically be considered a disability.

                  I worry about her a lot. I wish I could make her ex pay, but getting the divorce finalized and child support finally coming in will have to do for me.
