  • Should I get a lawyer? This doesn't seem right...

    So, as an update to my previous post......I have accepted a HS teaching position and the college job I was hoping for didn't pan out, but no big deal. I leave VA and move to NC August 2.

    So here's my ordeal. I coached Tennis for our boys team this past year, and most of the players didn't do their fundraising or pay for their uniforms. As you know, I was a teacher in the same division. The girls coach offered to handle uniform ordering and fundraising. Long story short, we owe like $4500 to our creditors and such. The superintendent said if it's not paid by June 30, that we would have the money payroll-deducted from our teaching checks. I think this is wrong because coaching and teaching are two different things, and also that I have signed NOTHING, not even a coaching contract. I've contacted a lawyer but waiting for him to get back with me. Do you think I have a case if they try and deduct my final checks?

    If you never signed a Coaching contract, ordering contract, funding contract, then you have zero responsibility to pay for uniforms for the schools team.

    The Parents of the students do need to pay for their kids uniforms, the school should have a fund for it, the kids should be taught responsibility and have to do fundraisers, BUT you have ZERO responsibility in this matter.

    The Lawyer is a good idea but honestly Id just tell the Superintendent to show you where you signed anything that said you were responsible for funding the team. If he cant then tell him you expect your pay in full or you sue and drag the school, team and him through the mud.

      I never signed any contracts for Tennis. I only signed a teaching contract which said nothing about this.

      Part of me thinks that they're after me since i'm leaving them. I spoke to a lawyer and he told me since my name isn't on any of the stuff, and my teaching contract said nothing about this, i'm not liable. Lawyer told me if I get docked, to call him immediately and he would come over and deal.

      Appreciate the help!

        Yep. Definitely keep the lawyer on the line for this. Many states do not allow unauthorized deductions, even for actual employees -- and it doesn't sound like you were an employee per se anyway.

          Agreed with Eric...also isn't your school system union, if so, keep your building rep in the loop.
          I'm trying to see things from your point of view, but I can't get my head that far up my keister!

                  Not sure where Mt Olive is. Where are you in relation to the big NC cities (Raleigh/Durham, Charlotte, etc.)??
