  • BIL sold house we are renting; we have 45days

    I'm typing this up in 2 parts. The first part is about the sale. Second part is how this house sucked.

    My now-husband was renting the house from his brother since 2006. BIL had bought this house then got a job in Portland, Ore six months after getting the house. Now BIL is selling the house to a flipper. Flipper saw the house and said we can take our time to move out. I said we would need 60 days. Flipper said, "ok" but sounded reluctant. This was on Thurs. Friday the BIL called my husband to tell him he sold the house. Husband told me Sat., said he forgot to tell me Fri. Geez. So since the rent is due in July on July 12, we can stay until July 12 or pay July rent if we want to stay until the end of July. We don't have a contract with him; if there was a contract we would not have to leave until the contract is up. So I'm not surprised we got the shaft. There is no water pan under the hwh, replacing it ($409 for the heater) is $900. Of course, flipper said it should not cost more than $200 for the labor. He said we can get the hwh and leave it for him, we can let the leak keep on leaking. Fuck that.

    One thing was about a week before the flipper came by, the hot water heater started to drip. The day the flipper came by he sais, "why you want to fix it when it's going to be sold? I would let it leak. I'm going to take out the carpet and floors." Lovely, ruin my shit for the next month with this leaking water. Also, I have a feeling if we let the water ruin the house the flipper will bitch about us ruining the house.

    So the things wrong with this house. the foundation. I don't know when that happened before or after the BIL bought the house. Crack on walls and floors The a/c needs to be replaced, pronto. No water drips except the time last year the part of the ac in the attic was acting up, and someone pushed the water pan, and the water was dripping from the unit, dripped on the closet, then water ruin the top of the closet, water leaks badly into closet, ruin my stuff. Then the closet gets mold and my husband buy mold soap to clean off the mold. Guess who had to clean off the mold? And I doubt mold soap is ligit, or the one he bought, seems came from China. The eaves need to be replaced. Also, this is Houston. It floods. It didn't flood this bad in this area before but too much development means more concrete, less green areas to absorb water. Luckily it never flooded this side of the block but the area in front of us has had houses flooded. A lot of houses are now raised about 6-12 feet in the areas that flooded.

    BIL is a cheapskate. He doesn't like being told there are repairs. He pays for 1/2 the repairs. Oddly BIL doesn't have us paying more than the mortgage payment. Usually when you rent you want to make the renter more than the mortgage payment.

    I'm guessing that those two things are closely connected -- i.e., he's using the latter as an excuse for the former. That being said, especially with no contract, you could also reasonably argue that the repairs are no longer your problem, either.

    Is there some temporary solution for the HWH issue that you could implement, such as putting an actual rimmed dish or pan under there, if there's room, and just checking it regularly?

      It sounds like you're ok with moving out, you just wanted more time. It sucks that the new owner isn't giving you more time, but as long as he's following applicable laws, I don't think there's much you can do there.

      As far as leaks and other repairs needed, that's the new owner's responsibility. Presumably the house was sold "as-is" (that's how practically all houses are sold in my area). If he says not to do anything about the leak, that's on him. As long as none of your stuff gets ruined, I wouldn't worry about it.

      Also, it sounds like you should have a discussion with your husband about maintaining your living space and not letting your belongings get ruined. I believe that's something you should both be on the same page about if you want to have a strong relationship.

          You should not be paying rent to BIL after the date of the sale. it's not his house anymore. Rent for after the sale date would go to the flipper.

            Update: the day the flipper came to see the house he wanted to see the garage. We opened it for him, and the husband closed the door, but I don't know if he didn't close it right. Latter that night I noticed the door looked crocked. The next day we say it was crocked. The automatic closer doesn't work, you have to lift it open or close. So again I call the repairman on Monday. He showed early on Mon (I scheduled him to come in Tues, but he called me and said he was in the area and will pass by), said we had to move boxes out of the way, so here I am crawling under the door, hoping it won't crash on me. Now Houston is hot now, felt like 108F at one point during the day. Several times I felt I was going to have a heat stroke. Repairman and his assistant showed up after 6pm, and finally could get in the garage. He said there was no way to fix the garage door. Either he can have it closed or open, but it would be stuck either way. Now there is a regular door we can go through, but other BIL has a muscle car he is storing in the garage for years (before I lived with husband, 2 years ago about, the other BIL lived in this house too), and we have to have a way for the car to be moved out. So we have to have the door made to be open. But the repairman said we can remove the bottom 2 panels. Another $175. Anyway, I sort of think it's a coincidence that the garage door broke the day the flipper showed up.

            The hwh is on a stand. The repairman said he had to lift up the hwh to put a pan under it, and cut a pipe to move up the hwh. There is no water cut off and so he had to turn off the water from a cut off in the yard. Though first he thought the water could be turned off from a valve just off the outside of the house. So thur. he had to leave, then came back, but had to leave again because his helper had a bible study to go to. I thought when he first left he was going to drain the hwh, but no, don't know why. He idd say it was going to take hours to drain since it will have to drain the water from all the pipes in the house. So I had him tell me how to turn off the water and drain the hwh. Seems turning off the water at the valve didn't turn off the water. I got up at 7:30 to hook up the hose and it didn't drain. Water was coming out, but it happened the water really didn't draining since the water was still on. So the repairman showed up around 2, and finally he had turned it off. It didn't take that long to drain. It cost $175 to get the repairman to lift up the hwh to put the pan. I have to drain the pan every 6 hours.

            I had a long discussion with the BIL about that; I was thinking the same thing. But seems that the closing date could be June 12, when the mortgage was due, so we don't have to pay the rent, or if the closing date is July 31, the day the flipper pays for the house, then we would have to pay rent on July12. But anyway, I was trying tell the BIL I want to talk to the flipper, since the flipper said we had all the time we needed to move out (though I didn't believe he meant it), so we don't have to pay rent to the BIL (maybe to the flipper), but BIL called back and said, "To help you guys you don't need to pay rent on July 12 but you have until July 31 to leave.

            Now the bag news (from all the bad news, you would think there wouldn't be this much) is all the houses we are looking at have the sellers adding that the houses won't be available for 90 days. I guess the time is needed for them to move out.

            When the BIL left to Portland, I think he was seeing my husband doing him a favor. Maybe BIL thought he was coming back, though he and his wife did good jobs in Portland.
