  • My Hip Update.

    So, I had yet another check up. This time I didn't have a doctor who himm and haaed.

    I have a tumor, the size of a golfball on my hip joint. Its eating my pelvis, and pushing my leg out of the joint. I need to get an operation on it to remove the tumor, and get a replacment. My next doctor who is the expert on it, is the 31st this month, who will then tell me when and what kind of hip replacments I'll get.


    On other bullshit news that made me see red, I have kept my boss updated on my hip since day one he started. He decided that the best cure for this, was naturally make me work on days of freight. I will be written up if I don't get frieght plus my other duties. I had put up with it until now. It just hurts too much, and the write ups are piling up, he just doesn't care about my hip. He says it's my job duty to do it.
    So, I got a second doctors note, telling them the same thing, just go easy on me. I can still do my job, just not as well as I might have. I have always gotten my cooler stocked. I only miss once a week on cleaning if I'm super busy. So I gave them the note. He called his boss.

    They decided the best course since there is no such thing as light duty in our job (Bullcrap BTW), was to take me off the work sedhceal. Permentally until my hip is repaired.

    Which, if I know corporate, will make me lose my insirence. Which means I'll have to pay for the whole damn thing.

    I hate that company. I hate my job. I hate how quickly they backstab and fuck you over. I been waiting for my raise that my area manager promised me. Then I get told that I don't deserve one because our store isn't that busy.

    I can't wait until I get out of there.

    Go straight to HR.. on how he is making sure you lose your insurance. Tell them if you lose your insurance.. you'll go to the media on how your boss knew about this.. and made sure you lost your insurance.

            That's a thought. If you can get a doctor to write a note saying it's a temporary disability and has been from such and such a date, it may just work. I'm not saying it will do, since I don't know the ins and outs of the US legislation, but that's a pretty good idea.

              I dont know if your company meets FMLA (FAMILY MEDICAL LEAVE ACT) guidelines, but its worth looking into. You may be able to be paid but be at home trying to get/keep well. PLEASE contact HR, LIKE YESTERDAY!!! Your boss is being a dick, you shouldnt have to deal with his inability to cope with your limitations.

              Also, not sure if ACLU can help (the American Civil Liberities Union) or if they deal with mostly racial/sexual issues, but look into that as well.

                I've used FMLA leave for maternity leave twice and also used it many times while my son was sick. My health insurance premiums were paid by my employer during my leave.

                Under FMLA they don't have to pay you wages (unless you have vacation/sick time saved up which you can use) but they do have to keep you on the rolls as an employee which means they have to pay their share of your health insurance premiums.

                If you are on medical leave under FMLA they can't fire you for being being on leave. And, since you won't be working, they can hardly come up with any other cause to fire you when you aren't even on the premises.

                Look into it. Yesterday.

                And, as others have said you can apply for FMLA medical leave retroactively. As long as you don't total more than 12 weeks (it doesn't have to be consecutive) in a year, you're covered for yourself or a family member.

                Edit to add: The federal FMLA guidelines apply to companies with 50 or more employees. In some states they can apply to companies with fewer than 50 employees.
