I WIN! YOU LOSE!!!
So last summer I posted a thread about filing against my Ex in court over money he owes me. Long story short, I loaned him money way too many times to get his power turned back on or to keep him from being homeless (mostly the latter). Stupid, but I was in love with the dog. He's been telling me for five years that he's going to pay it back and bear with him and he wants to do the right thing and blah blah blah (he has paid back approximately 1/4 of what he owes, the last of which was in April of 2008). (After I got things rolling with that, I decided it would be best to take down the thread just in case, so I had the mods hide it.) He defaulted, because his response to my suit was late (postmarked the day after it was due...) [of course this was all my fault
].
So I filed for a default judgment, and yesterday I had a proof hearing. The judge granted the judgment pending proof that Ex is not active military (trust me, they wouldn't want him). There is a DOD website that allows you to search by social security number, which I don't have. It also lets you search by name and birthdate, which I did, but the certificate it gives you says that without a SSN they can't guarantee that it is actually the person that you are looking for. The other option is to write separately to each branch of the military (including Coast Guard), for a fee of $5.20 each (certified check or money order), with as much info as you know about the person, and wait for weeks to get an answer. I was afraid that this is what I'd have to do. So I got all that together last night with the intention of going to the post office at lunch today.
Then this morning, it occurred to me...searching by his name/birthdate doesn't give me any matches, so what do I need his SSN for? If there was a match (or more than one), then I would need it to verify that it was not actually him, but since there is no match, there's nothing to verify. So I sent an email with my thoughts to my parents...then called them because I was too impatient for them to get it and answer. So then I sent them his full name and birthdate, they went on the site and printed out the certificate, and my mom took it over to the court to see if it was acceptable (if not, the post office near work is open until 7pm). They live 10 minutes from the courthouse, and she went with me to the hearing yesterday, so she knew where the courtroom was, and who the clerk is to give it to.
A couple hours later, I went out to the warehouse to check something and when I got back to my desk there was a message on my phone. My mom, calling to say that a card will be mailed to me to tell me that the judgment has been entered.
Now to get him to actually pay it....
Hopefully when he finds out I went after the judgment, he'll decide that I'm not going to go away and will stop making me do things the hard way.
Hey, a girl can dream, can't she?
I feel bad for his wife (he moved to Florida in October and got married in January - I even found a lovely little article from the local paper down there about their childhood-friends-who-haven't-seen-each-other-in-25-years-and-reconnected-through-facebook fairy tale <gag>). I hope for her sake they keep their major finances separate. Cuz I would bet money she doesn't know anything about this.
