Where did you find the info in the convention?

It almost certainly is an inflatable. It looks as though the near foot is resting on a flatbed lorry, which might also be providing an air supply and a tether to stop it blowing away. I assume there's another one on the far side.

I'm not sure how they stop it touching the electric wires over the railway though. Perhaps there's a hoop fitted to the bridge where we can't see it.

As for the upskirt perverts... those with the opportunity would mostly be the actual train drivers. Passengers would only see the legs going past, unless there's a bend in the railway within sight.
