    They aren't really co-workers and yet they aren't sucky customers even if they begged me to employ them. They are just apprentices. Either way they suck. This will be a bit long as I need to vent now that I have finally calmed down. Any advice for the possible deposition/court trial would be great. I have the records in both handed in and computer form. Sadly I don't know how my notes will hold up.

    With out going into too many details, I have had a week and am now getting sued. Well, not me personally but the union I work for. We're racist, play favorites and lie. Honestly I've seen the race card played so many times in stories on here but I never thought it would happen to me. OH that sounds like a Hustler story doesn't it. Someone cue the porno music?

    Slight background here. People interested in the apprenticeship program have to apply and pass basic things. From there, they are interviewed. This is given a weighted scale and the top ten (generally) are accepted into the class. Mind you, part of this interview is asking me, the admin asst. what my impression of these people are. I say you know, they came in very blah blah blah and treated me blah blah blah and this is given weight oddly enough. Not final word but the trustees trust my gut. I no longer do. Classes are paid for but don't pay. You get pay when you "go out" on the job. This is randomly selected after class and are placed on the board as such but combined with journeymen in line.

    This also depends on your skill. You don't want to send someone out on a skidloader if they have only shown you that they have forklift experiance. If you aren't employed, you're better off coming up and showing that you can run various pieces of equipment so that my boss can say "Yes I have seen them operate such and such and they are good at it". Seems easy huh?

    There are some in the last couple classes who are awesome with this. Rain/snow out, days off, after hours, et al they are up there making sure they have the skills (as they are supposed to be proficient in 5 pieces by the time they graduate). They are also the most requested for some odd reason. *eye roll* There are also those that do the very minimum, never come out for training and then complain when they are passed up. We're here for those.

    Being vague as hell, my company is being sued by one of those last few. Showing up for 15 minutes just to check in. Calling in and saying they'd have been there but they are sick/car is broken down/someone died. Claiming such greatness on the machines but has never shown it. You get the idea.

    I finally hit my last nerve with them after weeks of asking when they'd be up to show my boss what he can do about a month ago. Especially when he starts complaining that people are going out "out of order". Again I point out that we don't recommend to the hall that a first year with little to no experiance go out on a job that requires a higher level of experiance on a piece of equipment. This is a recommendation, not set in stone. They will send out who will fit the job.

    This last job had two higher level apprentices that managed to screw things up and get fired (no good) and the person who got sent out has made us proud so far. This after advanced training that he wanted to take on his own. We had no say in if he took this or not. But, it did help our standing with the contractors because yes, he knew what the funk he was doing.

    Well the proverbial shit hit the fan since x and y should have been up for this job. No matter that x and y were 1st years with no dozer experiance. Suddenly we're playing favs and we're racists (x and y are white...not sure how that's racist). Oh and don't forget everything I'd mention in class about their sheets and checking in have mysteriously been evaporated into thin air. Hell, the supposed fav boy is rather high on my shit list in terms of annoyance.

    My boss finally met with this meanie on Friday and kept his cool (bless him) to the best of his being. The other guy, according to my boss and the recording, lets you hear him throwing stuff around and acting like an entitled child. And my boss wonders why I was happy going to Jazzercise that night.

    I'm not too worried. The terms of Apprenticeship details what is expected of the apprentices and of the Apprentice program. I tell everyone that they HAVE to read through the terms before I give them the application. It takes at least 20 minutes for the average reader. Anything under that and we quiz them on the details. I know for a fact that he talked to my boss about the details. I also know for a fact that I went to bat for this SOB. He had a record like me. He's older, jumpy resume but very willing to work. I got snowed by him essentially.

    Take us to court. I have how many others that will back up that I told you all what you needed to do. We also have the agreement that will say that we will try but cannot guarantee placement as it is by the halls call due to talent. You wanna go you SOB? We'll go, I have documentation every time you called and told me you'd be in but didn't because you were sick.

    I stood up for you, told them you'd be a great person for the union. I told them your playful attitude would be a benefit for the stressful environment that is construction. They weren't sure with your record and I said that you had the dedication and drive. You just screwed me over with out even buying me dinner. You wonder why I am pissed?

    Oh and the best? Because we bought our property through the government, we can lose it through and EEOC case. WAY to fuck over your brothers and sisters in the union. Way to fuck your friends over at another union who said great things about you. Yeah we do talk. They know us and you and told us what was going on.

    Sadly this will not end well. I have no desire to appear in court but I know we'll have to in order to defend our good name. Entitlement will get you fucked over and I will not cry one tear for it.

    So the point of this post? It doesn't mean jack shit if you stick up for the "little guy". You can and will get fucked over. The whiney entitlement whores will always make your life a living hell in the end.

    This is a vent and depending on where it goes, I may have to delete it. But in the mean time, thank you for letting me vent and complain about those that don't deserve shit but are trying to get it.

    If they can't do the job right why should be hired? You do NOT have a right to a job. You ONLY have the right to pursue it. If you get passed up on a job because another candidate has more experience and can do the job better than you then it sucks to be you. What you do is work on getting that experience so you can better compete next time.

      I don't even play a lawyer on TV, but I've worked in HR and from what you've said it sounds like your documentation is right on the money. Claiming discrimination when you've called off more times than you've worked won't fly with that kind of backup. That along with signed contracts and verbal corroboration makes me think that this won't even get representation, let alone to a settlement or trial. Sounds like you've got your ducks in order on this one...well done.

      And yes, it does suck to feel betrayed by someone you stood up for, but in the end it's The Way It Goes. Not everyone is what they seem, and some people have no problem with manipulating the kindness of others to get what they want. We both know how unions treat that kind of behavior, so you know he'll get a comeuppance that no court could give. to you, and hang in there.

        From what you described, sounds like this guy doesn't even begin to have a case against you. Not with all the documentation you've made about his absences and his attitude.
