  • Quit or Get Fired.

    I was just told by some broad at the labor board that since we're At-Will, everything my job is doing to me is legal.

    Expecting me to placate violent customers
    Harassing phone calls into the middle of the night
    Trying to force me to quit by cutting my hours to unlivable wages (soon to happen, I assure you).
    Creating a hostile work environment

    All legal. My friend is calling his lawyer-brother to see what he says, theres no fucking way. I don't even want to go into what happened last night. Long story short, I lost most contact with reality. I could be grounded, but without strong supervision I just lost it. I called out five hours before my shift and was harassed with voicemails and text messages for TWO HOURS. Then they complained they "only had three hours" to find someone. Well, no, you had five, you used 2 to harass me continuously. Finally my counselor got on the phone and told them to fuck off, that I wasn't able to work and under no circumstance could I come in last night.

    Now I'm afraid to go to work. I work at 11pm so I wont see my manager (unless she purposely sticks around), but I can't handle this shit. I tried to tell everyone I can't do retail. The stress dissolves my brain and I fucking lose it. I doubt even meds will keep me on my rocker with all this shit.

    i don't even have the gumption to eat. Thats what started my friend worrying last night. I pick at food constantly. I dont eat a lot, but i'm always picking at something. I haven't eaten since yesterday. I'm hungry, but I just... cant bring myself to eat

    I can't believe that. I think you have grounds for a very tidy lawsuit here. If that broad at the Labor Board tells you something like that, go elsewhere. Document everything you can, at all times, and go to a lawyer.

      I have all the phone calls recorded, theyre sitting in MP3 format on my computer and a USB drive. If I have to go on unemployment, i should get an okay amount from my Census work and this job since I was making roughly 3k a month. I just.. I cant deal. I can't do this. Its ruining me.

        If you have any kind of savings at all that can help you a a short while, QUIT! Its not worth your sanity, hon. Take care of yourself.

          I don't. I have 300$ in my bank account and 350$ in bills due before the next payday. I might be able to get some cash, I have to make some phone calls.

            Im sorry. Is it feasible to have some fam or close friends help? It just sucks that you have to stay in that situation until a new job comes along.

            You may have a case for harassment though, or whatever else (i admit, im not up on workplace law in an at will state). Just do what you gotta do to keep yourself sane...and eat something.

              The labor board is a governmental agency and not to be trusted any more than any employer, IMO.

              I can't imagine any of that being legal anyway, but IANAL.

                My "workplace advocate" is going to call my manager. The woman is about as useful as gonorrhea in a thunderstorm. The last workplace thing she dealt with she quit the job on behalf of my friend. She said she'd call around 4 (its 3:50) so god knows whats about to happen. Apparently I need to "learn to work with people better." Suck my dick, bitch. Thank you for your input.

                Agoraphobia might have something to do with my lack of people skills, whore.

                edit 5:25: didnt want to make a new post. My advocate "called" she said she was told I was in the store "laughing and smiling" when I picked up my check. I told her someone just lied to her because all i said was "I need my check." I didn't talk to anyone. I might have smiled out of reflex, but I didn't realize smiling was a symptom of mental well being. My advocate said to let it go (how much more am i supposed to let go?) and give more notice next time. I told her I gave an hour more notice than I'm required to by policy. I don't schedule my mental breakdowns. "Well, theres nothing I can do about the past."

                Apparently its a-ok for me to come into work tonight. Yeah, im sure everything is going to be just dandy.

                  What are the laws in your state on recording phone calls? If you did not get the permission of the other person the phone calls will be inadmissible. Sorry, just making sure you are aware.

                      The cutting of hours is the only thing I can see them being able to do legally. The rest all sounds like hostile work environment, and I thought that was against federal law. I wonder if the board broad even knows what she's talking about. But...

                      A psychological disorder has nothing to do with it. Nobody has to put up with someone throwing things at them. If you don't have to accept being assaulted off the clock, you shouldn't have to on the clock either.

                      If workplaces treated their employees better, some mental illnesses might not even happen! I know my employers have ruined me!

                      If I were ever in a situation where I was assaulted at work like that, I would not rely on my employer to protect me. I would want to call the cops, fully aware that I might be fired, and would have a hell of a fight on my hands. You might want to ask your lawyer-friend if it would be illegal for them to fire you for that, just in case this happens again. Meanwhile, I hope you can fight them on this, because this is just WRONG!

                        This presumes, in order to be hostile, they would have to KNOW about my mental illness. they know i'm crazy (everyone on grave is crazy!), but have no documentation of illness.

                            http://www.rcfp.org/taping/states/california.html the actual law, not a random site. Its illegal to intercept or eavesdrop. Plus the privacy laws specifically state if calling from a public place (work), privacy is not to be expected because it can be overheard, thus making it legal. Most of my "recordings" are voicemails and text messages which theres no expectation of privacy for shit you electronically write down and leave on a recording device. The phone calls I have recorded are from the work phone, which eliminates the expectation of privacy.

                            I'm half sick from the thought of going to work. Tonight should be lovely. Ugh.

                              Whiskey, you can land yourself in a world of hurt over recording those calls. Any call recordings you have, get rid of them now. Voicemails you can keep. Texts you can keep. Call recordings? Get rid of them.

                              I'll quote from the same site you linked:

                              It is a crime in California to intercept or eavesdrop upon any confidential communication, including a telephone call or wire communication, without the consent of all parties.
                              Unless the people on the other end have given consent to being recorded while you are on the phone with them, you can wind up in deep shit, complete with criminal record and jail time.

                              Also, quick bit of news: Your work place is not public. It is private property. The person calling you from work has an expectation that the call is between you and that person. Unless they're standing out in the middle of a crowd while calling you, they do have a reasonable expectation of privacy.

                              Seriously, those phone call recordings you have could make life absolutely hell for you. Not just for now, not just for the duration of any criminal proceedings, but for the rest of your life. How many job applications have you filled out where one of the questions is about your criminal record? If those recordings are discovered, and you are convicted, you would have to tell any prospective employer that you were convicted of illegally recording your current employer's private communications with you. You might as well stick a big ol' sign on your forehead at that point that says "Don't trust me, and don't hire me."

                              The texts and voicemails produce an expectation of potentially being recorded. You can keep those. The call logs (which say when you were called, and by whom) can be kept. But the recordings must go.

                              For your own benefit, delete them right now. Please.
