  • Canadian employment legislation question?

Tonight I was shooed out of work at a couple of minutes past five...even though I was scheduled until half past.

Apprently there was an event going on and no staff had been scheduled so a couple of the staff were rangled into it, and needed to have a dinner break from 5pm-6pm so they could be back in time to staff the event.... they had us close up early and made me leave. They didnt ask me to stay and do the cash up, I even volunteered but it didnt make any difference.

Now I was scheduled until 5:30pm.... and was willing and able to work until that time... but they made me leave (I wasnt asked it I was ok with that) just after 5.

Do they have to pay me until 5:30 anyway? Or do I only get paid until 5? I know what the law is in my own country but K seems to think they have to pay me until I was scheduled because I was forced to leave. They wouldnt have to if I voluntarily left.

Im trying to find something online to figure it out either way as I hand write my time sheets.... I dont want to put 5:30 when im not entitled to it, although I have to say its right sucky that they force me to leave early when they know Im desperate for hours.... not that the supervisor could give a shit...

Kiwi, employment legislation for retail employees is provincially regulated, so it depends on which province you work in.

      This site should help you:

      http://www.labour.gov.bc.ca/esb/facshts/

For future reference: the BC Gov website is http://www.gov.bc.ca

I'll see if I can find anything else for you.

I'm pretty sure if you are a wage employee they don't have to pay you for hours not worked, even though you might have been scheduled for them.

That sucks. At least it was only 1/2 hour.

For future reference, here is the link to the Employment Standards Act (which is only in effect in BC):

            http://www.qp.gov.bc.ca/statreg/stat/E/96113_01.htm

Hope this helps with any future dilemmas.
