  • What part of "I am on the do not call list do you not understand?!"

So, I get a "no data" call.

I have no problem picking those up since I have friends who use Skype to call long distance with.

I end with some guy who asks me if this is my home phone number. I immediately go "Yeah, why?" in a snippy voice. I couldn't help it. I don't like answering freakin' questions before a proper introduction.

Guy is from Sprint. Goes on to say I won a NEW phone!

I interrupt and go "You *do* know I'm on the "Do Not Call List" right? I don't take solicitor calls especially if I haven't signed up for them. Thank you and good night."

    I was polite and firm.

Guy talks over me. Goes on with this sphiel about me having a cell phone and blah blah....

Again, I interrupt saying that I don't have a cellphone... I don't want a cellphone and Im' happy with my telephone plan. I don't take solicitor calls, good night.

    Keeps talking over me.

So I talked over him, informed him I was through talking and hung up.

    Was that sucky?

I would've gotten his name if possible, then called back to report him. As soon as you mentioned "Do Not Call," he should've ended the call. At the very most (and this would be pushing it), made one more polite attempt before terminating the call. Talking over you despite being told "no" twice earns him a black mark in my book, and I have very little negative to say about Sprint's phone reps.

    I'd say not sucky.

I miss the crank calls at the gas station. They were automated voice calls that said "Hello! This is your lucky day! You've won a trip to Aruba!" or some silly thing like that. I always wondered which one of us at the store won the trip, let alone how the hell did those people get our number? Why call a gas station?

I mean...no one really won anything, but it was so fun. I'd slam the phone down and yell at all my customers "OMG I JUST WON A TRIP!"

Not sucky at all. You said you weren't interested *twice* and he was ignoring you. This is *exactly* why people don't like telemarketers. Like you, if I say I'm not interested and they drop it, I have no problem with that. However, if they keep talking about their 'wonderful deal' I get annoyed. Annoyed enough that I'm no longer polite, and I *will* hang up on them. If they call back, I'm no longer nice

Why did/do you stay on the line? I feel no obligation to listen to their spiel. I react in one of two ways (well, one of three, but I don't really scream at them much any more): "I'm sorry, we don't take any telephone solicitations at all. Click." or What is your company's name? Thank you. What is your previous relationship with us? None? OK, we are on the Do Not Call list and you are in violation of federal law. I am now going to hang up and report this call." Then I do just that.

You got name but you need to get the employee name or number. Turn it in to your state attorney generals office. I think the fines start at about $10,000. If they continue to call you can sue and like a woman in my state win a bunch of $$. Just being on the Do-Not-Call list isn't enough because most people don't follow up, so some companies are figuring it's worth the risk to call anyway.

                  Hmm

Yeah, not that it makes it any less sucky on their part, but it sounds like you were probably talking to a recording.

Definitely report it to the appropriate people still - Sprint, the FTC, or both.

                    It was definately a person.

He tried to speed it up when I mentioned the 'do not call list' and got a bit nervous.

If it was a recording, damn, that voice actor was pretty talented!

Yeah, I was a total bitch to this one company who kept calling me. They wanted me to sell stuff out of their catalogues and they were based in freakin' FLORIDA... and in Spanish too! (It sucks being multilingual sometimes)

So after the second call I told him in no uncertain terms to sod off, leave me alone and that I was a *transplant* from another state. How the hell do they expect me to sell crap for them if I don't know anybody and NO I will not sic you idiots on my nice neighbors so you can leave me alone.

                      The hubby was surprised.

When he has already introduced him self as Lance or Bruce in an accent redolent of the Indian subcontinent, I don't think that would be a rewarding path to follow.

That was exactly what I was wondering. I myself used to get calls like this, and it turned out to be a recording. I always hung up.

Sometimes the autodialer will still dial people on the DNC list; but, in this case you weren't sucky at all. Even a hint of mention about the DNC, he should have ended the call right away.

Unfortunately a one time violation is not enough for a fine or a reprimand.

A second violation however is. Also, business have to subscribe to the DNC list in order to get the information thats on it, so its possible that for some odd reason Sprint doesn't have the DNC list information. I would be surprised if they don't but it is a possibility.

Telemarketing law is a nice fine and sticky mess in the USA.

A few fun lesser known facts that I like to use.

1: Telemarketers must provide a valid call back number if asked for one.

2: Telemarketers must also provide the name of the business they represent and at least the corporate address if asked.

3: Telemarketing calls to lines in which the called party pays for the call, IE cell phone or to an 800 number, are not legal.

Failure on points 1 and 2 can result in hefty fines if they are reported and found to be in violation of them. The problem is there are so many loopholes to get around certain rules. I'd have to double check, but I'm pretty sure not for profit calls, such as informing someone of a prize they have won, or calls from charities are exempt from the do not call rules.

I know political solicitations are exempt from the do not call list, but they are still subject to points listed above on telemarketing calls.
