good idea. though a registered letter is slow.
but i'm somehow betting she tries to skate out of giving a proper response.

is it actually legal for the hoa president to NOT live in the area? i am thinking that any proof that she doesn't actually live there may be legal cause to have a re-vote.

or just give her a copy of "Over the Hedge" and smile.

I have some friends that live in Valencia, CA some of the neighboring areas make you sign an agreement that if they let you move in there, you MUST agree to decorate your home for Christmas following whatever theme they pick that year and you MUST participate in the events they plan. If you don't, the fines can be $500.00+. I don't know what happens if you happen to be Jewish. So much for your home being your castle.

My dream in life would be to own a home that borders, but is not part of an oppressive HOA, just so I could thumb my nose at them.

That all depends on the by-laws. Some by-laws require all members to be owners, and all board members/officers to be members. Others don't (thus allowing for professional management of HoA).
I've lost my mind ages ago. If you find it, please hide it.

I know our last HOA President moved while he was still President. Rather than give up the spot he waited till April's election.

Our lawyer said that was OK as long as he still technically owned his house in the neighborhood (I.E. his house couldn't go to settlement)

Our by-laws state that to be on the board you must be an owner (meaning you name must be on the deed).

So, when she sold her place and moved out a "friend" of hers put her name on his deed making her a partial owner of his property (oh the IRS would LOVE this one).
