Unfortunately, this is true... No matter how screwed up it sounds. Kind of makes you feel sick knowing that the attorney would get into more trouble turning in the video than not showing it to the proper authorities. Has anyone here seen Cape Fear? In the film, De Niro's character raped and beat a 16 year old girl, and his attorney concealed evidence that said she was promiscuous. They make a mention of attorney-client privileges when the lawyer explains why he did it.Quoth reimero View PostActually, I don't think he can. So could he still turn in the video, if that's the case?I know, that sounds crazy, but the way the US justice system is set up, defense attorneys have to be protected from having to report evidence so the integrity of the system can be upheld. Also, to go back to the comment that priests should report what they hear in confession... absolutely no way. This would be a majorly huge violation of the division between church and state. More to the point, if a priest were to report something heard in the confessional to the authorities, that priest would be excommunicated, and could only be returned with direct personal intervention from the Pope. In "normal" layman's terms, that may not seem like much, but it's the Catholic Church's equivalent of capital murder.
Before you go saying how ridiculous that notion is, keep in mind that in many areas, oppressive governments try to use what is reported in the confessional to put people in prison, or worse, just for being religious or not agreeing 100% with the party line.

If the criminal charges were filed, I imagine the tape was in the police hands anyway. And to me it's kind of vague. Was the mom also having sex with her daughter? Or did the tape show a part where the guy had sex with the daughter and at another time having sex with the mom with another person? Though I can imagine mom will get jail time if she was in the video aware her daughter was having sex with the pedophile. Then of course, maybe she was the only one with a copy so it won't be seen by the police.The attorney took the tape home to review, and yes indeed, it was the accused man having sex with the 12 year old girl as well as a threesome with. . .

So...the cops don't already know what the mother did? See, I'm trying to think this through. The mother was stupid enough to show her lawyer the tape as "evidence", which means she intended to use it to sway the courts. Meaning the accused (or rather, the guilty), the parents and the judge would all see the tape. Personal feelings aside, no lawyer would intentially put their client in harms way, it's a conflict of interest. Thus the tape won't be shown, even if mummy dearest wanted it.
And yet...the "boyfriend" is in jail for the crime. He didn't mention it was a threesome? He didn't push this woman under the bus in order to save his skin? Nobody bothered looking at the mother? Or asking the daughter?
I'm thinking there are other levels to this crime and the investigation than we're hearing. The woman is greedy and stupid as hell, I only hope others are paying attention. This whole story makes me

i'm just thinking... the mom was OK with the sex before, why'd she suddenly change her mind and press charges?
obviously it was wrong in the first place, but ... im thinking her daughter's welfare only seemed to matter to her when she felt she could exploit it for something.
and technically now that the lawyer has "fired" her as a client, the "attorney-client confidentiality" won't apply anymore... so if perhaps he gets new data on this woman he will legally be allowed to (even obliged to) turn her in to the law.

Good evening, all. Just got home, and wow, look at all the posts. Sorry I didn't fill in all the blanks. Post in haste, repent at leisure.
My brother heard about this sub rosa by knowing the attorney personally.
The pedophile was originally arrested after the girl told a teacher at her school what was happening, but did not mention her mother's involvement.
Wouldn't you know it? Somehow, the tape DID wind up in the hands of the police. (ahem)
The mother was later arrested and charged as well, and the girl was placed in protective custody by DSS.
The proceeding were sealed, and my brother's friend was no longer involved in the matter, so I don't know what the outcome was. Imo, she should have been charged with participation in a rape and pimping.
And now for the million dollar question: why would the mother be so stupid to turn over this tape to an attorney? Because she was an abysmally ignorant and morally depraved trailer park piece of trash that had no clue that browbeating your 12 year old daughter into climbing into bed with a grown man is WRONG!!! When the attorney confronted her, he later described her as having a look of complete befuddlement on her face. She then tried to explain her actions with this stellar piece of lunacy:
"Old enough to bleed, old enough to breed!" ARRRRGH!!!
