    I can see no reason for a company to put a hold on your card unless you open up a tab. In a restaurant, you pay at the end, with a final total. That's it. I've never seen a hold on my card for a restaurant.

    No, if they have taken an additional 10 from his account, it needs to be dealt with, and fast. It's a big problem, tips being added on after the customer leaves. Don't let it get bigger.

    IF the restaurant doesn't willingly agree to go over the ticket with you, then threaten the police. Someone has broken the law at the very least. It may only be $10 / $50 with the bank fees, but it's still theft.

    Oh, and seriously think about changing banks. If they aren't willing to jump when a customer of theirs says someone has wrongfully taken money from their account, they're not worth keeping.

    Also, you may be able to go to the card company.

      Sounds like your bank needs a kick in the pants as well. Customer reports a possible fraud on their account and banks says they don't care?????

        In this situation he won't 'lose' if he fights, because there's nothing to lose. If he doesn't fight, he will lose, because he'll continue to be out fifty bucks.

          The "hold" is because the card is run before the tip is added, so the company wants to make sure there is room for tip on the card if you want to leave a tip. Most restaurant's "settle" at the end of the night and sent the card company the real amount. However, some systems don't work like that and the "hold" amount could should up for a day or two before the real amount is settled through.

            Yeah, if its a credit card, the CC company reserves an amount over and above the tab for an estimated tip. Then later in the evening, the restaurant will send the CC company the actual total the customer paid. The amount of the reserve gets adjusted up or down.

            Did you pay with credit or debit? You have almost no recourse with a debit card. The money's gone. That's why I always pay withe credit cards. If there's a problem, I dispute the charge -- problem solved.

              This has happened to me several times, but usually only for a few bucks and it never put me in a position like it did with your bf. Sucks that there are dishonest waiters/waitresses, cause I know what an horrific/thankless job that can be.. and I never tip less than 15% and usually only that little if the service sucked. In this case though, yea I'd take this all the way up the chain until it's resolved.

                Agreed. It's not only the customer getting screwed, the bank will lose as well.

                And I agree with everyone else that he should go back to Olive Garden and get this resolved.

                  First of all he used his debit card and it turns out that he cleaned his room that night and threw out the receipt so we can't really do anything. It sucks and I wish something could be done, but his roommates are helping him out so it could be worse.

                    Please don't let this go without a fight.

                    You don't have to have a receipt on your end to make a complaint at the store.

                    As said, if the waitress did this to him, she's done it to other people, too.

                    Just think, if one of those people had said something, he might have been saved all this hassle.

                    It's fraud and it should absolutely be reported.

                    The surest way to fail is to never even make the attempt.
