  • Old Story: Run-over by Cleaner Who Skipped Country

    I'm friends with one of our store owners. We have some similar experiences, family issues, and stories and I love her store, so I stop-in a lot during my shifts. One day she was mentioning how her back was acting-up (that on top of several health issues she is battling). She explained it was from an accident at a previous job. Boy! I did not know what an understatement that was!

    About 10-years ago she worked at a grocery store. There was a hired cleaning company that came in to do the floors and such. She was standing on a stepladder in an isle hanging signs with a coworker. She had her back to the end of the isle, and so didn't see the guy on the ride-on floor machine come barreling down the isle. The guy never stopped, slowed, sounded the horn or called-out that he was coming by. The only warning she got was the look in her coworkers face right before the floor machine hit her ladder and sent her to the floor. Then the idiot on the machine stopped and backed-up when her coworker screamed, thus running over her back. A Manager nearby witnessed the whole thing and questioned the cleaner.

    His excuse was that "When I am coming a woman had better get out of the way! I do not stop for anybody!" Apparently, he was also a (known) illegal immigrant and REALLY seemed to hate women in particular.

    While she was in the hospital my friend learned that the cleaner was taken off the job for a couple days, and then was right back at work! The next week, he hit ANOTHER female employee with the same machine, breaking her arm. The week after that, he hit a THIRD female employee and broke her collarbone. Since the company refused to fire the guy, the store management told them he was not allowed to clean their store anymore.

    When it came time for all of these incidents to go to a criminal trial, the cleaning company had let the employee (who was on parole with bail), go, and the employee had skipped the country; never to be brought to justice for his unprovoked attacks, nor to make restitution. The victims had to go after the cleaning company that employed this man and won a paltry sum for their trouble; certainly not enough for my friend to be able to pay for the medical problems she now suffers as a result of it.

    It's one thing to read about stories like this; another to know someone who experienced such from such a horrible, sucky person!

      Im sorry..but what THE FUCK to all involved.

      He runs over someones back, breaks an arm, then breaks a collarbone...

      He shouldnt have ben left back after the FIRST time...

      Your friend should not have taken any settlement offered and went after EVERYONE...that includes her own company for workers compensation for an on the job injury. The cleaning co was employing people without background check and SS numbers? IF the cleaning co was insured, this should have also covered something.

          There are just no words....

          Was the owner of the company just as sexist as the illegal? For crying out loud.....anyone with even a smidgeon of a brain would have fired the moron after the first incident, if not for the incident itself, for what he said!

          Although, karma works in very strange ways. May we someday find out what his demise may be.

            And this, dear friends, is what happens when you outsource the janitorial work to some contractor who'll hire whatever riff-raff walks in the door.

            If the cleaning guy was employed by the hospital, he'd be fired before you reach the end of this sentence. But he wasn't, so the hospital could only pass word of the incidents along to the contractor and hope they'd do the right thing, which they obviously didn't.

            A couple years ago, we had a cleaning guy who very easily could've done the same thing. He had such a hair-trigger temper, and if you'd tell to do something or not do something, he'd start hollering at you for "disrespecting" him and "you need to talk better than that to me" and so on. One morning he backed my supervisor against the wall screaming at her about...something, and she got so shook up she didn't come in to work the next day. Fortunately, after that incident he never worked in our store again. The cleaning company actually fired him, or at least sent him someplace else, and management directed us to call the cops if he ever showed up on our property.

              I think, seeing as how they accepted the payment from the cleaning company for their injuries, that they aren't allowed to sue.

                Since it's an old story than too much time as passed in all likelihood but depending on the jurisdiction she may have been able to sue anyway.

                  While everyone else is right in saying that both companies are rather sucky in their handling of this situation, I noticed another point of major suck: the courts.

                  An illegal is arrested for assault, criminal negligence, or whatever and processed. Bail is posted. Someone pays bail for him. He leaves the country. In such a situation, I would expect the police to immediately contact the DA or a judge to make sure that there is no possibility of bail. An illegal immigrant arrested for a crime on American soil is a MAJOR flight risk.

                    I got hired by a company like that. All I had to do was email them my resume and they hired me. I didn't even have to conduct a phone interview. I thought that seemed way shady, but I wasn't going to say anything since I was working for them.

                      wow, lawsuit city on that; she should have sued (i'm not in favor of lawsuits, generally, but the company was negligent on so many levels here) and then some for this crap. this is just inexcusable; hiring, allowing his behavior to escalate, injuring others and then doing NOTHING? what in the holy rolling hell here?
