    As with all things legal, your area may vary;

    However, in Canada, if the sales guy made that claim, and the customer could prove it, the provider would be legally required to honor it. The can fire the sales guy, but still have to uphold the deal with the customer.

    I went though almost this exact situation with Rogers several years ago. Sales guy promised me a too good to be true deal to upgrade and renew my contract. I got it in writing. Rogers billing tried to deny it. After a surprisingly short discussion with Rogers Canada legal department, they agreed to honor the contract rather than face fines many, many times larger than the discounts I got.

      That happen to my husband too. He bought the phone because we needed one since we'd just had our second kid and everyone was getting sick on a regular basis or needing extra stuff from the grocery or whatever. The person selling the phone happened to work at the place my husband works at so he was potentially getting a discount, but no, every time you call for those discounts you never seem to be able to get anyone to authorize it.

      This person knew so little about the phones she straight up said she couldn't have the data plan cancelled at all. Turns out, five months onward husband called the company to confirm a credit card charge had gone through, and they informed him that he could have bought the phone itself and a contract with no frills like data plans or internet.

      Now we have a tracfone of some kind and it charges you 20 cents to receive texts. Some man has been sending my husband pictures of himself posing for selfies and it's cost him about $5. /sigh

        contact the police and tell them your underage child/niece/nephew/friends kid plays with your phone all the time and this jerk is sending porn that the child can access. The nice policeperson will have a calm reasonable discussion with the jerk....

          Ah, now, I'm not that evil. According to my husband it's just pictures of some dude in his bathroom in the mirror, fully clothed. No hanky-panky or shennanigans, just a pain in the ass.

          Plan to buy a new phone though. Also I had him text the dude and say, "Sorry man, I think she gave you a fake number."
