This thread inspired me to go looking at some of the tips/tricks and I stumbled upon the "law" (or at least a paraphrased layman version of it)

The law (I only saw it cited for ice-cream but I would think it would be the same all around) is apparently akin to "If you are advertising ice-cream you need to use ice-cream if you are advertising anything else feel free to use crisco, powdered sugar, and food coloring"
Extrapolating then (as I am wont to do) If you are building a big mac for a commercial you need to use the same (precooked) burger patty they would use but you can cook it differently, the same bun they use but you can search for the most attractive bun, and spray it with / glue stuff on and protect it from sogging, apply the condiments with tweezers and syringes and not be illegal.
I have no idea how "suggested serving" and similar disclaimers factor in.
