Okay, this was one of my favorite cases from many years ago. I think it has aged enough now that I can post it. What I am posting below is a word for word explanation of why the claimant was fired. The background is simple; the claimant was discharged from a company that provided in home care to adults with disabilities. My job involves finding out if he was discharged for good cause.
Mr. Penny = claimant's false name
Reason for discharge:
Mr. Penny reported that he had attempted to exorcise a demon or spirit for a developmentally disabled client so that he would cease his habit of masturbating. He did this by forcibly holding him against a wall, pressing his hand on the client's forehead, and calling the spirit out. The experience was very disturbing to the client. Mr. Penny was terminated because (1) exorcising perceived "demons" is far beyond the care protocol prescribed for the client and contrary to the interest of the client (2) the potential trauma and risk of other behavioral issues, considering the state of the client is unacceptable, and (3) forcibly holding a client against a wall against their will is considered client abuse. We terminate anyone who is guilty of client abuse. Mr. Penny self reported this incident, leaving us no choice but to terminate him.
My response was
and I would call that a bit beyond 'disturbing' to the poor disabled man!
My fav part of this was a group of us who read it running around the office, showing it to the other workers, and then 'exorcising the demons' by pressing our palms against the reader's forehead and shouting some random phrases about spirits being commanded to leave. It entertained the entire office for months.
