First off, if a customer hasn't tried an item in my store before, ANY employee in the store is allowed to give them an item as a sample. This is pretty unique in and of itself, and I usually give away a handful of items a week. We just have to document what we're doing so the appropriate department can write it off.
Except for alcohol, as mandated by Texas law. As a retailer, we CANNOT sell alcohol at a price lower than what we paid for it - and we cannot give it away, period. I've had to remind our beer/wine dept of that law a few times now when customers have come up to me with beer/wine with a sample sticker slapped on it.
Today I had a few customers in my line - the one I was ringing up had a couple of different kinds of beer. The customer behind her struck up a conversation, started asking her about one brand of beer (a rather obscure one) and how it tasted.
The customer I was ringing up grabbed a beer out of the six pack, turned around, and HANDED IT TO THE GUY BEHIND HER and told her to try it on her. And she made sure to tell me "Make sure I pay for the beer I just handed him".
My jaw dropped to the floor. I've seen something like that a couple of times while hanging out in bars, but never at work.
My fingers may have accidentally touched a discount button on the register for a couple of items of hers after witnessing that. I don't really remember.
