I found out today that they told one of the employees pushing to get paid that "We don't know when, or IF, we are going to pay everyone the back checks."

As soon as I heard that, I called around various attorneys until I located one who dealt in employment law and would give me a free consult.

Since they "only" owe me $4100, it's not worth the fight. First major roadblock, we probably would have to pursue them in Florida court, since that's where they reported earnings. I live a loooong ways away. Then I'd have to pierce the corporate veil, get all three owners on the hook for this, prove malicious intent, show all my documents, and then hope for a judgement against them. It'd be heavy chances in my favor, but even still. I would only get a judgement, not money in my pocket.

I'd then have to spend time and effort enforcing the judgement. I could try to be allowed to file a lien, and I could even try for wage garnishment. The former would be tough, and the latter would be really really difficult to get, since they're not earning anything right now.

So I'd basically go through heck, over $4,000. The attorney was very nice, but said that it wasn't really worth all the time and effort I'd be putting in...and could be putting in towards bringing in more business/applying for jobs.

I'm done then, I guess. I just posted it onto my business' accounting software as a loss. Maybe it'll help on taxes. I hope.

Guess who contacted last week all "Hey, we are still trying to pay you, I mean, I haven't been paid in two weeks myself?" One guess, anything else and I will smack you. I promptly ripped him a new one, and he logged offline, and wouldn't answer any more IMs.

Well, it got more interesting yesterday. I follow their Facebook just for the sheer sake of keeping an eye on them, and had forgotten about it. Up until yesterday. I got a notification that they had made several new posts....about how they were all excited about their business and what they do.

Um, what?

Turns out they reopened their offices for business yesterday, without having paid anyone. I even called from a number they don't know, and their phones are all reconnected and taking calls.

This is good. Ohhhh, this is good.

Immediately afterwards, I called up the Dept of Labor. They were practically squealing in glee, and told me to file RIGHT THE HECK NOW. So I did. I just actually, like ten minutes ago before I posted this, sent twelve pages of documents and forms detailing what they did.

It's still not guaranteed. But now, at the least, the gov't is going to be ALL OVER THEM once this gets processed. Oh man, hopefully something comes of this. I so, so, SO want to see them get bitten hard for what they did to me and all the others. Totally unchristian of me, but eh, I'm only human. And seriously, I WANT THE SMITEDOWN.
