    Getting darn close to that line of unacceptability. We've no evidence of any thick skulls or raving idiots as yet, and going for breaking things over skulls is rarely acceptable.

      Definately!!! I remember an episode of "The people's court" or some such show with a situation similar to this. I can't recall the exact details but basically the decision wound up being that since the cheque was cashed, it was deemed to be accepted as payment in full.


      Getting away from the suck of the short payment, I can't get over what kind of moron this guy was about you not knowing your way around the complex. Fine, being Jewish may not be totally apparent, but I'm pretty sure the fact that you're female would be easily detectable. What kind of all male school is this guy running where any random girl off the street has complete knowledge of the layout?

        Pay me please, an update

        So I understand that with the holiday there's no one at the school to get this sorted out, but because I had contacted the school multiple times before the holiday I thought someone might have been able to look into it before the holiday, but of course no one over there cares about me. (I used the phrase "before the holiday" multiple times on purpose because every person I talked to forgot that I had in fact contacted the school multiple times before the friggin holiday. BTW, I do love Christmas, so nothing against "the holiday." I just wish I could have gotten my money BEFORE THE HOLIDAY as promised in the contract so I could have bought x-mas and Hanukkah stuffs. Cookies all around this year.)

        So today was the first day back to school and I finally get a reply from the teacher. He said he hadn't checked his e-mail at all during the break. Ok, I get that. So I resent the three e-mails I had sent before the break and asked what excuse he had for not replying to those.

        Anywho, he claimed at 1st that everything was right, so I went into the school to personally show him the check that clearly said thirty dollars and not three hundred (big diff. by the way.) He never apologized, but said that if the check didn't come by wed. to contact him again. Yeah, keep ya posted.

                I'm a bit surprised that no one has mentioned the obvious (to me) fact that flutes_and_fabric is dealing with a SC who is also a sucky employee. Ask to speak to the manager! And the manager in this case is the school's principal, who is probably a priest. I'd guess (though I could be wrong) that there's a rectory attached to the school, where the priests live. Had it been me, I'd have been knocking on that door.

                Now that everything's all straightened out -- assuming the check comes as promised -- that's moot. But this teacher still did a piss poor job of representing the school, and his boss ought to know this. Send a letter.

                  In the future too, when you do contracts like this, you should probably consider adding a late fee markup clause. If the agreed upon amount isn't paid in full by X-days after agreed upon time, then late fees of Y% per day will be added. (Make sure Y% isn't too high to avoid any local laws)

                          Here's the update as promised: No friggin check. We have resolved the whole $30 thing though. They indeed did make a mistake. I asked for a letter signed by the principal that clearly states that $30 of the $300 fee has been payed, and the service provider (me) is still owed $270 which will be payed in full in a separate check. I refused to leave the school until I got his signature on the letter which was written up and also signed by the teacher who hired me.

                          Now here's the big question: Is it actually in the mail yet? From his e-mails I've gathered that he believes the school has all ready placed the check in the mail. I don't think they have.

                          I sent an e-mail earlier today informing him that I had not received payment for my services yet. He didn't get back to me, so I just sent another e-mail offering to stop by the school to pick up the check.

                            I think it is time to stop dealing with the teacher and ask for the accounting dept. They are the ones who will put it in the mail, not him.

                              I think you need to send a certified letter stating that if payment for the balance of the full amount owed ($270) is not received by (4-5 days from date of letter), there will be a late fee of $X per day including weekends that will be owed. If they try to say that the agreed fee was a flat $300, your response is that the payment was that amount conditional on payment by the due date so they broke their part of the agreement already.

                                Yeah, don't cash any check until it's the full amount. I'd also suggest telling them that if you don't receive the check by Saturday, you'll take legal action. If it actually does go to the point where you sue them, put in your statement that you want the full $300 plus x% for each day it was late.
