Given that no lawsuits ensued from Sarge's inducement of bowel-breaking bricks on his would-be assailants, I applaud his actions.

It's a recognized fact that street attackers of any kind (muggers or gangbangers out looking for someone to jump) gravitate toward easy prey. If someone carries themselves confidently (or visibly carries a weapon), they look for someone else.

... I am training to be a police officer and so I also have a concealed carry permit and I carry frequently. Yesterday I was at my university and I found out my first class of the day was canceled. I decided to go sleep in my car for the two hours until my next class... I immediately bolt up and place my hand on my weapon, but do not draw. They ran off.

Not too much drama, but really? How do you miss the sleeping girl in the backseat with an exposed firearm on her hip?!?

Just to clarify here: does having a CCW permit allow you to carry both concealed and unconcealed? Or were you able to carry unconcealed because you are a LEO?

This absolutely varies state to state, but in my state you don't need a permit at all to carry unconcealed (although there are restrictions such as felons can't have weapons at all and other things). Given that I have a permit I can carry concealed or open. With the permit I can carry open with a bullet in the chamber - without the permit the bullet has to be two away from the chamber. I usually carry concealed because a lot of people will actually confront people that are open carrying and tell them off for doing so, which makes no sense to me. If you are so scared of someone carrying a weapon, why would you walk up to them and start a verbal altercation? At any rate, I am not a LEO yet. I am only training and hoping to get hired somewhere. Even if the driver was in the right, was actively being robbed, and was not found criminally responsible for shooting the robbers, the robbers with the right lawyers can still make the pizza chain pay for the robber's injuries. Hell, homeowners have been sued by burglars who got injured on their property.

Under Georgia's castle doctrine, if the shooting is ruled as self defense, the intended victim has immunity from lawsuits. Not a lawyer but I'm willing to bet that a good legal team could argue that would also cover the employer.

I'm a food delivery driver.. I carry a 9 mm, and I know how to shoot it too (I made damn sure I was properly trained on proper handgun usage and safety, I was trained by a former police officer)

We live in the boonies in central Texas (very near where all the Labor Day fires were, and are still smouldering). DH has his concealed carry, and his Federal Firearms License, meaning he can also sell and/or trade guns. We have enough of an arsenal that I'm not too horribly worried about any two-legged "critters" trying to break in. I don't have my CC yet, but only because my shoulders are still too weak to be reliable in an emergency situation.

Lately, the only thing we've had to worry about is the four-legged "critters" that have been chased out of their normal habitat by the fires. The coyotes are hungry, and are getting braver and closer as they get more desperate.

You can sue anyone for anything. Doesn't mean you will win, and I've never heard of a case where a criminal sued a victim and won.

Courts follow the "clean hands" doctrine. You must come to court with clean hands. If you were doing something wrong when the alleged incident happened, the courts are not likely to be sympathetic.

Bearing in mind that IANAL, I think that for a robber to win against the pizza chain in this example, the robbers would have to prove that the manager knew about the gun, then failed to tell the driver not to carry the gun per policy, or failed to discipline (fire) the driver if he continued to carry the gun. Good luck with that.

It really depends on the state. In many states, you don't need any kind of a permit to open carry, LEO or not.

My local paper did a story on a fellow who open carries all the time. He never goes anywhere unarmed, unless the place of business prohibits weapons (like a bank). Our state allows you to do this, so he does.

I've open carried before (was traveling between home and a gun range); have a shoulder holster for the M1911A I used to own, and open carried with that. Walked right in front of a cop, who did not bother me.

Hi Panacea, yes if the management knew about the weapon then there'd likely be a case and it would be up to the courts to decide if the castle doctrine extends immunity to an employer. Sooner or later that's going to happen and it will be interesting to watch because it will definitely have an impact on companies' policies on employee possession of firearms during the course of their duties.

In Georgia, the legislature tried to pass a law that prevented employers from prohibiting employees from keeping their firearms locked in their vehicles while at work and on company property. Corporatist society that we are, it got watered down to the point of being useless. So basically we're a "don't ask, don't tell" state in that regard.

Georgia is an open and concealed carry state with the Georgia Weapons License (used to be Georgia Firearms License). I open carry everywhere I go. It is very rare that I get any reaction at all and when I do it is always positive.
