          Another note along the lawyer line. Take pictures of yourself to show judge if it goes to court. She should have to pay the medical costs at least.

              Day 2

              Bruises are turning different colors!! Still mostly black though. A lot of the bruising is deep tissue, so they haven't surfaced yet, if they will at all, but they HURT. Still sore. Getting ready to go back to work. This should be fun.

                I'm glad you are ok....the last person I knew that got hit by a car wasn't so lucky.

                Definitely sue her and talk to the hospital and see what you can do ....you don't want to go to collections over this hospital bill.

                Doesn't the person with the car, and car insurance pay for some of this stuff?

                    Which is doubly weird - that's illegal in Texas. Apparently a tow-able offense. Which means she should have been charged with at least one crime.

                      Dunno about the laws in Lupo' state, but over here, whenever a traffic accident occurs the police has to establish who is responsible for the accident. And the responsible trafficant is liable, no matter whether he/she is insured or not.

                      So yeah, I'm on the "get a lawyer ASAP" train as well.

                      ETA: Of course there are accidents caused by, say, a driver having a heart attack and therefore not having control over the vehicle. In such an incident noone would be deemed responsible/liable from the police. But in this case (high speeding in a parking lot) it's pretty obvious.

                          I don't know. They could have issued citations or towed the car after the ambulance took her off. She needs to get the report, find out if there's something fishy going on, and get a lawyer.

                            I won't be able to get my hands on the report for 10 working days, so next Thursday at the earliest. The investigator came in to talk to me while they were hustling me to xrays, and they booted her out. She gave me a copy of the on scene information exchange, and said that a citation was issued, I think. I was kind of stoned at that point.

                            But according to this sheet of paper, the woman didn't have a license, just a state ID, and there was no insurance on the car.

                              Does Third Party Insurance come with rego at all in your state? Part of the rego costs for my car include Compulsory Third Party Insurance, which covers me if I hit a person (not that I will). My separate insurance will cover me if I hit someone else or another car, as well as being covered for Fire and Theft.

                                Call the DA's office or the County Courthouse info line, whichever one you find first for the jurisdiction in which you were hit. Start off by admitting that you don't know for certain what you should be doing and ask them for help. Then describe what you know. Tell them you don't want to waste the court's time or their time, but at the same time you want to make sure this woman receives the proper consequences for what she did so that she (AND her daughter!) will be less likely to do it to someone more fragile. They can tell you what information to get in what order, and at what point you take all this stuff to a particular office and the professional decides whether to swear out a warrant or officially lay charges.

                                I'm in Alabama, not Texas, so the procedure may well be different than what I wound up following. Back last April, a repeat offender stole a pickup truck, drove around a large block a few times (why? no one ever figured out), raced up a hill through a red light and hit my little old RAV4 broadsides. He powered through us, causing me to rotate more than halfway through a circle and flip over, made a right-had turn around us as we spun, and went around that same block AGAIN. And came back and looked at us as the ambulance was checking my passengers over. And then he drove off in the opposite direction, went to the boobie bar, and rammed their dumpster until the stolen truck's engine was too bent to function.

                                Drugs may have been a factor.

                                Anyway, my point is that my insurance company -- the default authority figures in this case -- went after the owner of the truck, because obviously the thief had no insurance, nor property worth mentioning. I called the courthouse and found out what I needed to do to press charges against the driver, because if that guy was so casual about hitting us, he sure as hell was going to do it again to someone else, unless it cost him in the way of some personal consequences.

                                If the woman who hit you doesn't have the capacity to learn anything from this, what about the daughter riding in the car with her? This woman and her daughter manhandled you while trying to get you to say you were fine -- does this qualify as attempting to intimidate a victim? Isn't that technically what she was trying to do to you?

                                Go get her, Lupo! You can give that daughter one good chance to turn out a better human being, if nothing else!
